Background
During the previous Business Committee meeting on December 13, 2023, it was requested that
the Economic Development, Diversification, and Community Development team to review the
request from the Safe Shelter for a $35,000 donation to be used for operational costs for this
year.
Current Request
On December 13, 2023, Safe Shelter Inc. Requested a $35,000 donation to maintain operations
for the homeless shelter. The following is the Business Committee motion on the request.
Motion by the Business Committee to direct Justin Nishimoto, Business Analyst to draft a
resolution for $35,000 of the Economic Development, Diversification, and Community
Development fund to be donated to the Safe Shelter with the review and recommendation to
be submitted for the business committee meeting on January 10th, 2024.
The donation is to be used for operational expenses for the 2024 year.
Findings after review
The information supplied by Safe Shelter Inc., identifies operational expenses below:
• $27,571.23 for calendar year 2023 amount for utilities (electric and gas)

Safe Shelter Inc. has identified $37,571.23 for operational expenses for the past year and the
$35,000 will cover for this upcoming year for operational expenses.
The Guiding Documents utilized to determine the use of the EDDCD funds include the Broad
Goals and the Comprehensive Plan Elements which have the following housing related items:
➢ Housing- We want Tribal members of all income levels and family sizes to be given the
opportunity for affordable housing by filling vacant homes and meeting all housing needs by
fully funding existing and future programs by the end of this term to give them a feeling of
security.

for a Donation of $35,000 to the Safe Shelter, Inc
Summary
The resolution approves an allocation of thirty-five thousand dollars ($35,000) from the Economic
Development, Diversification and Community Development Funds for the purpose of a donation
to Safe Shelter, Inc. to continue operations.

Analysis by the Legislative Reference Office
The Oneida Business Committee has adopted resolutions which set aside funds disbursed from
corporations to the Nation in an Economic Development, Diversification and Community
Development fund (“the Fund”) and describes the process for accessing those funds. [Resolutions
BC-09-28-16-B, BC-07-12-17-A, BC-12-12-18-B, BC-01-23-19-C, BC-01-23-19-D, and BC-0526-21-B]. When a request to utilize monies from the Fund is received, the Review Team,
comprised of the Strategic Planner, Business Analyst, and the Budget Analyst, review the request
for use of the Fund and determines if the proposed use is consistent with the Fund. The Review
Team is then required to provide a written recommendation to the Oneida Business Committee
regarding whether to authorize the allocation from the Fund to a specific project identified by a
contract number, CIP number, economic development opportunity number or other easily
trackable number or designation. The Oneida Business Committee is then responsible for
authorizing use of the Fund by a resolution clearly identifying the amount of funds authorized and
purpose of the funds, which may be identified by a contract number, CIP number, economic
development opportunity number or other easily trackable number or designation, and the
employee responsible for authorizing expenditures of the authorized amount.
Through the adoption of this resolution the Oneida Business Committee would be approving an
allocation of thirty-five thousand dollars ($35,000) from the Economic Development,
Diversification and Community Development Funds for the purpose of a donation to Safe Shelter,
Inc. to continue operations. This resolution provides that the donation to Safe Shelter, Inc. is not
intended to be used for salaries or related expenses. Utilizing the Fund for this purpose is aligned
with the Oneida Business Committee Broad Goals and approved Comprehensive Plan Elements
related to housing. Executive Director of the Safe Shelter Inc., Pearl Webster, is identified as the
responsible employees for this allocation of funding. This resolution does not directly provide a
contract number, CIP number, economic development opportunity number or other easily
trackable number or designation – but this funding could be tracked through the resolution number.
Conclusion
Adoption of this resolution would not conflict with any of the Nation’s laws.

WHEREAS,

the Oneida Nation is a federally recognized Indian government and a treaty tribe
recognized by the laws of the United States of America; and

WHEREAS,

the Oneida General Tribal Council is the governing body of the Oneida Nation; and

WHEREAS,

the Oneida Business Committee has been delegated the authority of Article IV, Section 1,
of the Oneida Tribal Constitution by the Oneida General Tribal Council; and

WHEREAS,

the Economic Development, Diversification and Community Development Fund was
created by resolutions # BC-09-28-16-B, BC-07-12-17-A, and BC-01-23-19-D and the
procedures for use of the fund set forth in resolution # BC-12-12-18-B, BC-01-23-19- C,
and BC-05-26-21-B, Updating and Clarifying Access to the Economic Development,
Diversification and Community Development Fund As Amended; and

WHEREAS,

the Safe Shelter, Board of Directors was created in October of 2019 and worked with the
Oneida Nation to identify 2155 Hutson Road as a location to serve as a homeless shelter;
and

WHEREAS,

Safe Shelter, Inc. received their 501 (c) (3) status on March 29, 2022, and has begun
writing grants under their own status; and

WHEREAS,

securing additional funding is a long-term endeavor and Safe Shelter, Inc. wishes to remain
open to serve the homeless population; and

WHEREAS,

the Oneida Business Committee has directed the EDDCD team to review and recommend
the use of $35,000 for a donation to the Safe Shelter, Inc; and

WHEREAS,

utilizing the Economic Development, Diversification and Community Development Fund to
support a homeless shelter is aligned with the Oneida Business Committee Broad Goals
and approved Comprehensive Plan Elements related to housing.

NOW THEREFORE BE IT RESOLVED, the Oneida Business Committee does approve the allocation of
$35,000 from the Economic Development, Diversification and Community Development Funds for the
purpose of a donation to Safe Shelter, Inc. to continue operations.
BE IT FUTHER RESOLVED, the $35,000 donation is not intended to be used for salaries or related
expenses.

A proposal for “Lifetime Achievement” was brought forth to a BC Work Meeting
December 07, 2023 and received approval for recognition of “Lifetime Achievement”
recognition for former Tribal Leaders and/or Judges with funding from the special
events budget. We are planning to recognize retired Oneida Business Committee

council member Lois J. Powless and Wendell McLester at the January 10, 2024 Oneida

The nature of this request is for a resolution conferring BC consent to apply for the 2023 Tribal
Cyber-security Grant Program. The purpose of this grant is to assess the current state of Tribal
cyber-security to determine if any gaps exist, to determine the cause of any gaps and to correct
those gaps. The amount of funding available is based on the number of applicants but will be no
less than $153,592.96.
The grant requires no matching funds and will not impact Tribal contribution.

The memorandum is intended to provide you information regarding the resolution
entitled Updated Oneida Business Committee 2023-2026 Term Assignment to Standing
Committees.
Background
At the start of the 2023-2026 term, the Business Committee (BC) met to determine
assignments for the Standing Committees. The Treasurer shared his interest in being
assigned to the Audit Committee, however, the bylaws which were in effect at that time,
prevented the Treasurer from being assigned to the Audit Committee.
BC resolution # 09-13-23-F, Oneida Business Committee 2023-2026 Term Assignment
to Standing Committees, was adopted assigning three (3) BC members to the Audit
Committee rather than four (4). The BC also took the following action:
Motion by Lisa Liggins to direct the Legislative Operating Committee to review
the Audit Committee bylaws dated December 14, 2022, specifically Section 14.b.1.A. that prohibits the Treasurer from serving on the Audit Committee and
determine if amendments are appropriate, seconded by Jennifer Webster. Motion
carried:

WHEREAS,the Oneida Business Committee has been delegated the authority of Article IV, Section 1, of
the Oneida Tribal Constitution by the Oneida General Tribal Council; and

position to be placed on the 2024 Special Election ballot.
