Approval of 2025-2026 Alcohol Beverage License for the Oneida Hotel
Summary
This resolution permits the Oneida Licensing Department to issue a license to the Oneida Hotel to
sell alcohol beverages at the Oneida Hotel in accordance with the Nation's Alcohol Beverage
Licensing law and the prevailing laws of the local municipality, the Village of Ashwaubenon,
Wisconsin.
Submitted by: Grace L. Elliott, StaffAttorney, Legislative Reference Office
Date: July 15, 2025
Analysis by the Legislative Reference Office
The Nation's Alcohol Beverage Licensing law ("the Law") was adopted with the purpose of
governing the sale of alcohol beverages by businesses owned by the Nation or incorporated under
the laws of the Nation, on all land within the exterior boundaries of the Oneida Nation Reservation
and any lands added thereto pursuant to federal law. [5 O.C. 507.1-1].
The Law sets forth requirements for an application for a license to sell alcohol beverages by the
Nation, including the procurement of a license to sell alcohol by the local municipality. [5 O.C.
507.4-1]. The Oneida Licensing Department has reviewed the Oneida Hotel renewal application
for an alcohol beverage license along with all required documents and has determined the Oneida
Hotel is in compliance for licensure.
In addition, the Law requires that the Oneida Licensing Department not issue any licenses for
selling alcohol beverages until adoption of a resolution by the Oneida Business Committee
granting such license. [5 O.C. 507.4-2]. Through this resolution the Oneida Business Committee
grants a license to sell alcohol at the Oneida Hotel by the Oneida Hotel, to be issued by the Oneida
Licensing Department.
The license issued by the Oneida Licensing Department shall run concurrent with the license
issued by the Village of Ashwaubenon. [5 O.C. 507.4-4(a)}.
Conclusion
Adoption of this resolution would not conflict with any of the Nation's laws.

Statement of Effect
Participation in Kunhi-Yo (I am healthy) Annual Conferences
Summary
The resolution directs the authorization of up to two (2) hours of paid work time for employees of
the Nation to attend the annual Kunhi-Yo Conferences.
Submitted by: Clorissa N. Leeman, Senior Staff Attorney, Legislative Reference Office
Date: July 11, 2025
Analysis by the Legislative Reference Office
As a result of increased drug abuse throughout the Reservation, the Behavioral Health Program
has worked in coordination with the Tribal Action Plan program and identified resources and
services to respond to drug and alcohol abuse and its impact on members and families. The
Behavioral Health Program has received a Tribal Opioid Response grant which supports the
Kunhi-Yo “I am healthy” Annual Conferences at the Oneida Hotel & Conference Center. The
Oneida Business Committee supports resources and services that provide assistance in reducing
drug and alcohol abuse and its impact on members and families, and believes that all employees
within the organization can benefit from having the opportunity to attend the Kunhi-Yo “I am
healthy” Conferences. The Chief Financial Officer identified that this is a budgeted expense.
Through the adoption of this resolution the Oneida Business Committee directs the authorization
of up to two (2) hours of paid work time for employees of the Nation to attend the Kunhi-Yo
Conferences. This resolution provides that all employees are required to obtain supervisor
authorization prior to using this paid work time, and that supervisors are encouraged to make
scheduling arrangements to allow employees to attend. This resolution clarifies that the two (2)
hours of paid work time cannot result in over forty (40) hours worked in the work week. The
Oneida Business Committee directs the Executive HR Director to inform supervisors and
employees of this action.
Conclusion
Adoption of this resolution would not conflict with any of the Nation’s laws.

Statement of Effect
Use of Wisconsin Tribal Assistance Grant Funds
Through the adoption of this resolution the Oneida Business Committee identifies Mark W.
Powless, General Manager as the project owner and approves uses of the Tribal Assistance Grant
funds.
Submitted by: Clorissa N. Leeman, Senior Staff Attorney, Legislative Reference Office
Date: July 11, 2025
Analysis by the Legislative Reference Office
The Budget and Finances law (“the Law”) sets forth the requirements to be followed by the Oneida
Business Committee and the Oneida fund units when preparing the budget to be presented to the
General Tribal Council for approval, and establishes financial policies and procedures for the
Nation which:
ƒ institutionalize best practices in financial management to guide decision makers in making
informed decisions regarding the provision of services, implementation of business plans
for enterprises, investments, and capital assets;
ƒ provide a long term financial prospective and strategic intent, linking budget allocations to
organizational goals, as well as providing fiscal controls and accountability for results and
outcomes;
ƒ identify and communicate to the membership of the Nation spending decisions for the
government function, grant obligations, enterprises, membership mandates, capital
expenditures, technology projects, and capital improvement projects;
ƒ establish a framework for effective financial risk management; and
ƒ encourage participation by the Nation’s membership. [1 O.C. 121.1-1].
The Nation is required to develop, adopt, and manage an annual budget. [1 O.C. 121.5-1]. All
revenues and expenditures of the Nation shall be in accordance with the annual budget. Id. The
Nation’s annual budget is required to be a balanced budget, which does not propose to spend more
funds than are reasonably expected to become available to the Nation during that fiscal year. Id.
The Budget and Finances law addresses an occasion when the Nation receives unbudgeted
supplemental funding. The Budget and Finance law provides that in the event that the Nation
receives any supplemental or emergency funding of two hundred and fifty thousand dollars
($250,000)or more, the Oneida Business Committee shall develop and adopt, through resolution,
a spending plan to guide expenditures of the supplemental funding in accordance with any
provided guidance for the supplemental funding and audit compliance. [1 O.C. 121.6-4(c)].
This resolution provides that in 2023 the Oneida Nation received one million dollars ($1,000,000)
from the State of Wisconsin as a Tribal Assistance Grant. Per the terms and conditions, “the Nation
may use the Grant Award funds as the Nation deems necessary, except that no Grant Award funds

may be used to pay for gaming-related expenses.” The Oneida Business Committee provided
guidance to use the funds for the purpose of strengthening the Oneida Nation community, as well
as strengthening relationships with neighboring communities, and the Oneida Business Committee
reviewed proposed uses during the Thursday, April 3, 2025 BC Work Session.
The Oneida Business Committee then adopted resolution BC-04-14-25-B, Use of Wisconsin Tribal
Assistance Grant Funds, which identified Mark W. Powless, General Manager as the project
owner and approved the following uses of the Tribal Assistance Grant:
ƒ Oneida Reads to hire two staff to provide summer early literacy supports utilizing fifty
thousand dollars ($50,0000).
ƒ Oneida Nation School System to implement track and field upgrades utilizing one hundred
fifty thousand dollars ($150,000).
ƒ A donation to Great Lakes Inter-Tribal Council for the Adolescent Recovery and Wellness
Center utilizing thirty thousand dollars ($30,000).
ƒ A donation to the City of Green Bay for the Ted Fritsch Park water feature utilizing one
hundred thousand dollars ($100,000).
ƒ Oneida Tourism to fund Oneida Nation upgrades in preparation for the NFL Draft, utilizing
one hundred twenty thousand dollars ($120,000).
ƒ Oneida Intergovernmental Affairs to fund the installation of Oneida welcome signs
utilizing one hundred fifty thousand dollars ($150,000).
ƒ Oneida Tourism to fund the 2025 Oneida Pow Wow utilizing one hundred fifty thousand
dollars ($150,000).
ƒ Bay Beach Shoreline Improvements Project utilizing one hundred thousand dollars
($100,000).
ƒ Family Resource Center donation utilizing one hundred thousand dollars ($100,000).
Resolution BC-04-14-25-B did not specify whether the allocation of the Tribal Assistance Grant
was an unbudgeted supplemental funding, but if it was, then the adoption of this resolution
complied with section 121.6-4(c) of the Budget and Finances law.
This resolution identifies Mark W. Powless, General Manager as the project owner and approved
the following uses of the Tribal Assistance Grant:
ƒ Oneida Public Works will purchase and install Knox Boxes on Tribal facilities to allow
emergency access to emergency responders. This activity will be coordinated with Oneida
Fire Marshal, Tanya Hill, utilizing twenty-right thousand dollars ($28,000).
ƒ Oneida Public Works will update AED Cabinets in our facilities for eleven thousand two
hundred dollars ($11,200).
ƒ Oneida Public Works will provide repairs and updates at our parks totaling ten thousand
eight hundred dollars ($10,800).
Again, this resolution does not specify whether the allocation of the Tribal Assistance Grant was
an unbudgeted supplemental funding, but if it is, then the adoption of this resolution complies with
section 121.6-4(c) of the Budget and Finances law.
Conclusion
Adoption of this resolution would not conflict with any of the Nation’s laws.

Resolution titled “Submission of Oneida Nation P.L. 102-477 Plan to the U.S. Department
of the Interior”

Presented for the Business Committee’s consideration is a resolution titled “Submission of Oneida
Nation P.L. 102-477 Plan to the U.S. Department of the Interior.”
BACKGROUND - WHAT IS 477?
Public Law 102-477, known as the Indian Employment, Training and Related Services
Demonstration Act (25 U.S.C. 3401 et seq), was established to enhance the ability of federally
recognized tribes to address their employment and training needs. The primary intent of the 477
Program is to streamline and consolidate various federal grant programs related to employment,
training, and related services into a single, cohesive plan, budget, and reporting system. This
integration is designed to align with tribal priorities, reduce administrative burdens, and enhance
the efficiency and effectiveness of service delivery within tribal communities.
This permanent legislation, first adopted in 1992, has no expiration date gives tribes the authority
to integrate federal employment and training-related services into a single plan. Participation is
voluntary, and the Bureau of Indian Affairs (BIA) is the lead federal agency for the interdepartmental project. As of 2024, BIA reports that it has approved 83 Tribal 477 Plans
representing 303 federally-recognized tribes.
Reported Benefits of Participation in 477 include:
x

Improved client services: Increased number of clients served, and improved outcomes for
clients

x

Better utilization of program staff: Case Managers can now serve clients based on
multiple client needs, not based on where the money for their salaries originates.

x

A single intake system: With only one file for each client, it eliminates the need for
multiple files for the same person. The amount of information maintained on each client
Page1of5

Public Packet

87 of 380

is also reduced because the federal 477 report form is often simpler than those used for
any of the individual programs.
x

Reduction in federal paperwork: Statistics show that the number of reports that must be
provided to federal funding agencies is reduced by over 90% from what was required of a
tribe before 477 was introduced.

x

Tribal plans can follow tribal, rather than federal priorities: Public Law 102-477 aims to
empower each participating tribe to set their own goals for services.

x

A single budget: The public law specifically states that a tribe will submit only one
budget for all the funds included in their 477 plan.
