Temporary Moratorium on Development, Construction, and Operation of Data Centers
WHEREAS,

the Oneida Nation is a federally recognized Indian government and a treaty tribe
recognized by the laws of the United States of America; and

WHEREAS,

the Oneida General Tribal Council is the governing body of the Oneida Nation; and

WHEREAS,

the Oneida Business Committee has been delegated the authority of Article IV, Section 1,
of the Oneida Nation Constitution by the Oneida General Tribal Council; and

WHEREAS,

the Nation expresses and mades decisions based on its core values, the Good Mind as
expressed by Onʌyoteʔa·ka,
• Kahletsyalúsla, which is the heartfelt encouragement of the best in each of us,
• Kanolukhwásla, which is the compassion, caring, identity, and joy of being,
• Kaʔnikuhli·yó, which is the openness of the good spirit and mind,
• Kaʔtshatstʌsla, which is the strength of belief and vision as a people,
• Kalihwi·yó, which is the use of the good words about ourselves, our nation, and our
future,
• Twahwahtsίlayʌ, which is all of us are family, and
• Yukwatsίstayʌ, which is our fire, our spirit within each of us; and

WHEREAS,

Data centers are computing facilities that may require substantial amounts of electricity,
water, land, telecommunications infrastructure, and other resources to support their
operations which does not include internal computing infrastructure conducted by
businesses; and

WHEREAS,

the rapid expansion of data center infrastructure across the United States has created
significant questions regarding environmental impacts, energy consumption, water usage,
land use compatibility, infrastructure demands, cybersecurity risks, and long-term
economic benefits; and

WHEREAS,

the Business Committee finds that incomplete information currently exists regarding the
potential impacts of data center development, and

WHEREAS,

desires to provide adequate time for consultation with the Nation’s members, technical
experts, governmental partners, utility providers, and other stakeholders concerning the
potential costs and benefits associated with such facilities; and

WHEREAS,

a temporary moratorium is necessary to preserve the status quo while the Nation conducts
a comprehensive review of appropriate regulatory, environmental, cultural, and economic
considerations related to data center development; and

NOW THEREFORE BE IT RESOLVED, effective immediately upon adoption of this resolution, a one-year
moratorium is imposed on:
a. The approval of applications for permits, leases, licenses, land use approvals, or other
authorizations related to data centers;
b. The approval of any new data center development projects;
c. The construction or expansion of data center facilities; and
d. The establishment of agreements involving the Nation’s lands, assets, utilities, or infrastructure for
the purpose of supporting data center operations.
BE IT FURTHER RESOLVED, the Chief Counsel shall provide a report on the application of the Nation’s
laws and jurisdiction authorities which would be affected by or require amendment to effectuate the changes
recommended in the CEO-Nation Services report and may be adopted by the Oneida Business Committee
after receipt of the report.
BE IT FURTHER RESOLVED, during the moratorium period, the CEO of Nation Services shall conduct an
assessment of the environmental, economic, cultural, public health and technology impacts of data centers
and bring forth a recommendation identifying if there are any circumstances with which the Nation would
consider granting such a facility to be built within the Nation’s reservation.
BE IT FINALLY RESOLVED, during this moratorium, corporations wholly owned by the Nation are
instructed that the Corporate Social Responsibility Policies should include and recognize this policy of the
Oneida Nation regarding financing, developing, and constructing data centers during the moratorium period
and until such time as the Oneida Business Committee identifies a long-term policy position.

Narrative/Background:
Prior to the 2026 National Congress of American Indians (NCAI) Mid-Year Convention
and Marketplace, I accepted the position as Midwest Region Primary Vice President. The
Midwest Caucus convened during the NCAI Mid-Year Convention to discuss regional
communication priorities, review a proposed communication plan for the 2025–2027
term, address procedures for filling the vacant Midwest Regional Vice President
Alternate position, and receive standing updates on policy issues impacting Tribal
Nations in the Midwest Region. As Midwest Vice President, I facilitated the election to fill
the Midwest Vice President Alternate position during the convention at the Midwest
Caucus.
I also serve as co-chair of the Land and Natural Resources Committee meeting. The
Committee seeks to promote and protect environmental stewardship, sustainable
resource management, self-governance of hunting, fishing and gathering, and ensuring
lands and resources continue to support the health, safety, and wellness of the Next
Seven Generations. A portion of the committee’s responsibility is to review and provide
input on proposed resolutions. This year we reviewed the Roadless Rule Resolution that
focuses on affirming
“the protection of cultural resources, sacred sites, subsistence resources, water
quality, fish and wildlife habitat, and forest health is best secured through
approaches that preserve Tribal sovereignty, Tribal access, and place-based Tribal
co-management, and that any national policy affecting inventoried roadless

areas, whether the existing Rule, its rescission, or any legislative measure, must
respect the authority of each affected Tribal Government to shape the
management of the specific areas within its ancestral lands;”
Attendance at the NCAI Executive Council meeting provided updates on organizational
leadership, federal policy priorities, governance reforms, financial sustainability, youth
engagement initiatives, civic participation efforts, and future convention planning.
Discussions reflected NCAI's continued efforts to strengthen organizational
effectiveness, improve fiscal accountability, and expand advocacy on behalf of Tribal
Nations. Leadership highlighted recent collaboration on Native language preservation
and implementation of the Native Children's Commission, emphasizing NCAI's role as a
key partner in federal tribal policy discussions. A major policy discussion focused on
prediction markets and the proposed Clarity Act. Concerns were raised regarding the
potential expansion of gambling-style "event contracts" through cryptocurrency
platforms and the associated impacts on tribal gaming revenues. NCAI leadership
continues to engage federal policymakers to oppose provisions viewed as harmful to
Tribal Nations.
The Executive Council discussed several governance-related matters, including:
x Expansion of committee co-chair positions to improve participation and ensure
continuity of council operations.
x Appointment of Liz Homer as NCAI Parliamentarian following the departure of
Patrick Patterson.
x Formation of a task force to review NCAI's constitutional voting structure and
representation model. Members acknowledged that tribal demographics have
changed significantly since the organization's founding and that voting formulas
may require modernization while maintaining fairness among large and small
tribes.

including federal advocacy related to tribal gaming protections, voting and
representation reforms within national tribal organizations, civic engagement initiatives,

WHEREAS,

the Oneida Nation is a federally recognized Indian government and a treaty tribe
recognized by the laws of the United States of America; and

WHEREAS,

the Oneida General Tribal Council is the governing body of the Oneida Nation; and

WHEREAS,

the Oneida Business Committee has been delegated the authority of Article IV, Section 1,
of the Oneida Tribal Constitution by the Oneida General Tribal Council; and

the Oneida Nation recognizes and supports the Great Lakes Intertribal Food Coalition
(GLIFC), a tribal organization that empowers tribes to achieve their food sovereignty goals;

The purpose of this agenda item, OBC Special Projects Budget Expenditure of Funds
SOP, is to review and formally approve the drafted changes to Standard Operating
Procedure (SOP).
Background

This SOP was brought forward for consideration at the February and June 2026 Oneida
Business Committee (OBC) Work Sessions. At that time, the OBC agreed that
improvements should be made to the existing SOP to establish clear guidelines
governing Business Committee Special Projects funding requests.
After the two OBC work sessions and a meeting with the Director of Government
Administration and the Government Administration Executive Assistant, the following
revisions were drafted:

Unidentified Expenses or Unidentified Funds were revised to Unplanned
Expenses or Unplanned Funds
x The OBC Area Manager was updated to Director of Government Administration
x Guidelines for requests were revised to must align with an approved Nation
Building Project or an OBC Strategic Initiative
x

Once available funds are verified, The requestor now has five business days from
being notified to obtain OBC support to utilize the unplanned expense allocation

The attached draft was presented and effective date of October 1, 2026 agreed upon at
the June OBC work session.

DEFINITIONS

Fiscal Year: Oneida’s fiscal year begins on October 1 and ends on
September 30 of each year.

2.2

Director of Government Administration: Position number 02974 that is
responsible to carry out delegated budget responsibilities on behalf of
the Oneida Business Committee and supervises the Government
Administrative Office.

2.3

OBC Special Projects Budget: Fund unit assigned #4272041, where OBC
budgets and expends dollars to support term-specific government
initiatives.

2.4

Mission: To strengthen and protect our people, reclaim our land and

enhance the environment by exercising our sovereignty.

Native Nation Building: Intentional use of five (5) principles in decisionmaking and long-term planning which are 1) Transformational
Leadership, 2) Strong Governing Systems, 3) Seventh Generation

Strategic Initiative: a comprehensive plan that an organization sets out for
achieving its strategic goals or long-term visions for improvement. (If a
goal asks what you want to achieve, a strategic initiative explains how you

Unplanned Expense: a set amount in the OBC Special Projects Budget at
the beginning of each fiscal year which does not have a pre-planned
allocation.

WORK STANDARDS / PROCEDURES
3.1
Funds shall be budgeted in the OBC Special Projects Budget at a set dollar amount in
each fiscal cycle.
3.1.1
Processing the OBC Special Projects Budget in accordance with the
Nation’s budget processes is the responsibility of the Director of
Government Administration and/or designee(s).
3.1.1.1
The Nation’s budgeting process is governed by law, Chapter
121 titled “Budget and Finances.”
3.1.2
The Director of Government Administration shall provide a
recommendation on the amount for the upcoming fiscal year based on a
previous three (3) year expense average and any specific requests from
the OBC.
3.1.3
The recommended dollar amount for the upcoming fiscal year will be
provided to the OBC no later than March 1 of each year.
3.1.4
The OBC shall ratify or modify (increase or decrease) the recommended
dollar amount no later than March 31 of each year.
3.1.5
Final dollar amounts in the OBC Special Projects Budget shall be
approved as part of the Nation’s approved fiscal law and policy.
3.2

Sign off for the OBC Special Projects Budget is delegated to the Director of Government
Administration or designee.

3.3

All funds expended from the OBC Special Projects budget which fall into the
“Unplanned Expense” category of allocation(s), shall be approved by not less than

Submitting Requests for Funding Allocation
3.4.1
Each OBC member may identify a special project to be funded in an
upcoming fiscal year.
3.4.1.1
Requests should include a summary of the purpose and an
estimated dollar amount.
3.4.1.1.1 Summary and purpose of the request must align
with an approved Nation Building project or an
OBC Strategic Initiative.
3.4.1.1.2 Ineligible special project requests:
