BC Resolution # 08-12-26-D
Amendments to the Boards, Committees, and Commissions Law
WHEREAS,

the Oneida Nation is a federally recognized Indian government and a treaty tribe
recognized by the laws of the United States of America; and

WHEREAS,

the Oneida General Tribal Council is the governing body of the Oneida Nation; and

WHEREAS,

the Oneida Business Committee has been delegated the authority of Article IV, Section 1,
of the Oneida Tribal Constitution by the Oneida General Tribal Council; and

WHEREAS,

the Boards, Committees, and Commissions Law was first adopted by the Oneida Business
Committee through resolution BC-08-02-95-A; amended through resolution BC-05-14-97F; emergency amended through resolution BC-04-12-06-JJ; then subsequently amended
through resolutions BC-09-27-06-E, BC-09-22-10-C, and BC-09-26-18-C; emergency
amended through resolutions BC-03-11-20-B and BC-03-17-20-C; and most recently
amended through resolution BC-08-12-20-B; and

WHEREAS,

the purpose of the Boards, Committees, and Commissions Law is to govern boards,
committees, and commissions of the Nation, including the procedures regarding the
appointment and election of individuals to boards, committees, and commissions, creation
of bylaws, maintenance of official records, compensation, to establish clear standards of
conduct, and other items related to boards, committees, and commissions; and

WHEREAS,

on January 10, 2024, the Oneida Business Committee adopted a motion to defer the
Board, Committees, Commissions law to the Legislative Operating Committee for a
revision of the eligibility for veterans to serve on veteran related committees and to have
open eligibility with no exclusions; and

WHEREAS,

amendments are also being sought to restructure the authority of the newly created
Boards, Committees, and Commissions Department, to enhance standards of conduct, the
prohibition against conflicts of interest, enforcement provisions, and a variety of other
amendments to strengthen and clarify the duties and responsibilities of each entity,
member, the Oneida Business Committee, and the Boards, Committees, and
Commissions Department; and

WHEREAS,

the Legislative Operating Committee developed the proposed amendments to the Law
through collaboration with representatives from the Oneida Boards, Committees, and
Commission Department, the Oneida Government Administrative office, the Oneida Law
Office, and the CEO of Nation Services; and

WHEREAS,

in accordance with the Legislative Procedures Act a legislative analysis and fiscal impact
statement were completed for the proposed amendments to the Law; and

WHEREAS,

the Legislative Operating Committee held a public meeting on the proposed amendments
to the Law on June 11, 2026, with three (3) individuals providing oral comments, and the
public comment period for the amendments to this Law was held open until June 18, 2026,
with no submissions of written comments received; and

WHEREAS,

the Legislative Operating Committee accepted the public comments on July 1, 2026; and

WHEREAS,

the Legislative Operating Committee reviewed and considered the public comments on
July 1, 2026, and accepted an updated public comment memorandum and draft on July
15, 2026.

NOW THEREFORE BE IT RESOLVED, the Oneida Business Committee hereby adopts the amendments
to the Boards, Committees, and Commissions Law, which shall become effective on August 26, 2026.
CERTIFICATION
I, the undersigned, as Secretary of the Oneida Business Committee, hereby certify that the Oneida
Business Committee is composed of 9 members of whom 5 members constitute a quorum; 6 members
were present at a meeting duly called, noticed and held on the 12th day of August, 2026; that the forgoing
resolution was duly adopted at such meeting by a vote of 5 members for, 0 members against, and 0
members not voting*; and that said resolution has not been rescinded or amended in any way.
