Background
On April 22, 2026, the Oneida Business Committee appointed Judy Dordel and Terryl
Wheelock to the Southeastern Wisconsin Oneida Tribal Services Advisory Board.
§105.9-1 All appointed and elected positions are official upon taking an oath during a
regular or special Oneida Business Committee meeting, or at an alternative time and
location as determined by the Secretary. All rights and delegated authorities of membership
in the entity shall vest upon taking the oath.

Oneida Nation Assistance Fund Application Submission Period and Disbursement Timeframe for
2026
WHEREAS,

the Oneida Nation is a federally recognized Indian government and a treaty tribe
recognized by the laws of the United States of America; and

WHEREAS,

the Oneida General Tribal Council is the governing body of the Oneida Nation; and

WHEREAS,

the Oneida Business Committee has been delegated the authority of Article IV, Section 1,
of the Oneida Tribal Constitution by the Oneida General Tribal Council; and

WHEREAS,

the Oneida Business Committee adopted the Oneida General Welfare law, 10 O.C. 1001,
through resolution BC-12-08-21-A for the purpose of governing how the Nation provides
assistance to eligible members, on a non-taxable basis, through approved programs that
promote the general welfare of the Nation pursuant to the principles of the General Welfare
Exclusion; and

WHEREAS,

the Oneida Business Committee adopted the Oneida Nation Assistance Fund law (“the
Law”), 10 O.C. 1003, through resolution BC-11-30-22-A for the purposes establishing the
Oneida Nation Assistance Fund to provide financial assistance to its members to address
their general welfare needs, pursuant to the Oneida General Welfare law; and

WHEREAS,

section 1003.5-1 of the Law provides that the Oneida Nation Assistance Fund is open to
any individual who is a member of the Nation, is age eighteen (18) or older, and submits a
completed application during the designated submission timeframe; and

WHEREAS,

section 1003.5-2 of the Law provides that the Oneida Business Committee is responsible
for setting forth through the adoption of a resolution an application submission period and
disbursement timeframe for a distribution of assistance from the Oneida Nation Assistance
Fund; and

WHEREAS,

section 1003.5-4 of the Law provides that assistance provided through the Oneida Nation
Assistance Fund shall be disbursed in accordance with the timeframe set through
resolution by the Oneida Business Committee; and

WHEREAS,

section 1003.6-1 of the Law provides that the Oneida Nation Assistance Fund shall be
funded through the Nation’s annual budget, and by any other funding source deemed
necessary by the Oneida Business Committee; and

WHEREAS,

section 1003.6-2 of the Law provides that the Oneida Business Committee shall determine
the amount of assistance available to an eligible recipient from the Oneida Nation
Assistance Fund per any permitted distribution; and

WHEREAS,

the Oneida Business Committee approved and adopted the Fiscal Year 2026 Budget
through GTC-12-08-25-A, in which twenty two million seven hundred and five thousand
three hundred and twenty dollars ($22,705,320.00) was allocated for a potential general
welfare assistance program for the Oneida Nation’s eligible members, and the budgeted
funds would provide up to one thousand five hundred dollars ($1500) to each enrolled
Oneida Nation member whom is at least eighteen (18) years of age by September 1, 2026;
and

WHEREAS,

the Fiscal Year 2026 Budget also included an allocation of seven million three hundred and
thirty five thousand eight hundred and forty dollars ($7,335,840.00) was allocated for a
potential general welfare assistance program for the Oneida Nation’s eligible members age
sixty two (62) and older, and the budgeted funds would provide up to two thousand dollars
($2000) to each enrolled Oneida Nation member whom is at least sixty two (62) years of
age by December 31, 2026; and

Amount of Assistance for Disbursement
NOW THEREFORE BE IT RESOLVED, in accordance with section 1003.6-2 of the Oneida Nation
Assistance Fund law the Oneida Business Committee determined that for the Fiscal Year 2026
disbursement the amount of assistance available to an eligible recipient from the Oneida Nation Assistance
Fund shall be as follows:
 General Disbursement. A disbursement of assistance of one thousand five hundred dollars
($1,500) is available to any eligible applicant who is an enrolled member of the Nation, at least
eighteen (18) years of age by September 1, 2026, who has submitted an Oneida Nation Assistance
Fund application.
 Additional Disbursement for Elders. An additional disbursement of assistance of two thousand
dollars ($2,000) is available to any eligible applicant who is an enrolled member of the Nation, at
least sixty-two (62) years of age by December 31, 2026, who has submitted an Oneida Nation
Assistance Fund application.
Application Submission Period and Disbursement Timeframe
BE IT FURTHER RESOLVED, that in accordance with section 1003.5-2 of the Oneida Nation Assistance
Fund law, the Oneida Trust Enrollment Department shall make available an application form for the Fiscal
Year 2026 disbursement of the Oneida Nation Assistance Fund by June 1, 2026.
BE IT FURTHER RESOLVED, applications for the Fiscal Year 2026 disbursement of assistance from the
Oneida Nation Assistance Fund shall be accepted until 4:30 p.m. on August 7, 2026, with the disbursement
of assistance to be made on or before August 31, 2026.
Late Application Submission Period and Disbursement Timeframe
BE IT FINALLY RESOLVED, any eligible members missing the initial aforementioned application deadline
may submit a late application for the funds by 4:30 p.m. on March 1, 2027, with the late distribution being
made on or before March 27, 2027.

Elder Assistance Program Application Submission Period and Disbursement Timeframe for 2026
WHEREAS,

the Oneida Nation is a federally recognized Indian government and a treaty tribe
recognized by the laws of the United States of America; and

WHEREAS,

the Oneida General Tribal Council is the governing body of the Oneida Nation; and

WHEREAS,

the Oneida Business Committee has been delegated the authority of Article IV, Section 1,
of the Oneida Tribal Constitution by the Oneida General Tribal Council; and

WHEREAS,

the Oneida Business Committee adopted the Oneida General Welfare law, 10 O.C. 1001,
through resolution BC-12-08-21-A for the purpose of governing how the Nation provides
assistance to eligible members, on a non-taxable basis, through approved programs that
promote the general welfare of the Nation pursuant to the principles of the General Welfare
Exclusion; and

WHEREAS,

the Oneida Business Committee adopted the Elder Assistance Program law (“the Law”),
10 O.C. 1002, through resolution BC-07-13-22-A for the purposes establishing the Elder
Assistance Program to provide financial assistance to its elders to address their general
welfare needs, pursuant to the Oneida General Welfare law; and

WHEREAS,

it is the policy of the Nation to prioritize the general welfare needs of its elders and
recognize that its elders possess unique and irreplaceable stores of knowledge, skill,
culture, and experience that enhance and enrich the lives of every member of the Nation;
and

WHEREAS,

the interests of the Nation are advanced when its elders remain confident that their general
welfare needs can be met; and

WHEREAS,

section 1002.5-1 of the Law provides that the Elder Assistance Program is open to any
individual who is a member of the Nation, is age sixty-five (65) or older, and submits a
completed application during the designated submission timeframe; and

WHEREAS,

section 1002.5-2 of the Law provides that the Oneida Business Committee, in consultation
with the Oneida Trust Enrollment Committee, is responsible for setting forth through the
adoption of a resolution an application submission period and disbursement timeframe for
a distribution of assistance from the Elder Assistance Program; and

WHEREAS,

section 1002.5-4 of the Law provides that assistance provided through the Elder
Assistance Program shall be disbursed in accordance with the timeframe set through
resolution by the Oneida Business Committee; and

WHEREAS,

section 1002.6-1 of the Law provides that the Elder Assistance Program shall be funded
through the Elder, Education and General Welfare Trust Fund, which is derived from the
Emigrant NY Indian Claims Award Docket 75 Trust Fund. The Oneida Business Committee
may obligate additional funding to the Elder Assistance Program through any other funding
source deemed necessary by the Oneida Business Committee; and

WHEREAS,

section 1002.6-2 of the Law provides that the Oneida Trust Enrollment Committee shall
determine the amount of assistance available to an eligible recipient from the Elder
Assistance Program per any permitted distribution; and

Amount of Assistance for Disbursement
NOW THEREFORE BE IT RESOLVED, in accordance with section 1002.6-2 of the Elder Assistance
Program law the Oneida Trust Enrollment Committee determined that for the Fiscal Year 2026
disbursement from the Elder Assistance Program amount of assistance available to an eligible recipient
who is age sixty-five (65) or older by December 31, 2026,from the Elder Assistance Program shall be seven
hundred three dollars and fifty-four cents ($703.54).
Application Submission Period and Disbursement Timeframe
BE IT FURTHER RESOLVED, that in accordance with section 1002.5-2 of the Elder Assistance Program
law, the Oneida Trust Enrollment Department shall make available an application form for the Fiscal Year
2026 disbursement of the Elder Assistance Program by June 1, 2026.
BE IT FURTHER RESOLVED, applications for the Fiscal Year 2026 disbursement of assistance from the
Elder Assistance Program shall be accepted until 4:30 p.m. on August 7, 2026, with the disbursement of
assistance to be made on or before August 31, 2026.
Late Application Submission Period and Disbursement Timeframe
BE IT FINALLY RESOLVED, any eligible members missing the initial aforementioned application deadline
may submit a late application for the funds by 4:30 p.m. on March 1, 2027, with the late distribution being
made on or before March 26, 2027.

Solid Waste Citation Schedule

Shekoli,
The purpose of this memorandum is to update the Business Committee on the progress of
preparing the requested Citation Schedule. The Waste Management Team drafted a citation
schedule several month back in preparation for the passing of the amendments for the Solid
Waste law. We were not aware at that time that the schedule needed to be in a particular
format but were provided examples of other schedules. The Waste Management Team rewrote
and submitted the schedule to the Law Office.
Attorney Krystal John reached out and offered to help through the process and wrote the draft
resolution which was then submitted to Attorney Clarissa Leeman for a statement of effect.
Clarissa informed me there were conflicts with the Citation Schedule. She explained what needs
to be addressed in the schedule and the resolution before she can complete the statement of
effect. As such, I would request this topic be deferred to the next meeting of the Business
Committee.

$150,000 allocation. The signs can no longer be repaired due to the age and the BIE funding to address

WHEREAS,

the Oneida Nation adopts a budget for each fiscal year which identifies how anticipated
funds will be utilized; and

WHEREAS,

at the end of each fiscal year, the difference between actual expenditures and actual
revenues results in carry over funds which are available for use after the funds have been
subject to the Oneida Nation’s annual audit; and

WHEREAS,

the General Tribal Council has identified that 25% of the audited carry over funds shall be
allocated to land acquisition in accordance with the 2033 Land Acquisition Plan, resolution
# GTC-09-18-10-A, 2033 Land Acquisition Plan; and

WHEREAS,

the remaining audited carry over funds, 75% of the audited carry over, is managed and
reported out in the Treasurer’s Report in the “Owner’s Report” (report on investment
restricted and unrestricted funds) and has been allocated within the approved the budget
and for projects; and

WHEREAS,

the Oneida Business Committee adopted resolution # BC-10-21-22-A, Process to
Authorize Use of Carry Over Funds, to track the amount of carry over funds and how those
funds are being used to better monitor budget development, budget revenues and
expenditures, and allocation for projects; and

WHEREAS,

a request to use one hundred fifty thousand ($150,000) to fund an endowment fund for the
Norbert Hill Center and Oneida Tribal School Sign Replacement, and

WHEREAS,

this request has been presented to the Oneida Business Committee, and the Finance
Office has identified the current status of the carryover fund balance to determine
availability of funds; and

Summary
The resolution authorizes the use of one hundred fifty thousand dollars ($150,000) to fund the
Norbert Hill Center and Oneida Tribal School Sign Replacement.

Analysis by the Legislative Reference Office
The Budget and Finances law (“the Law”) sets forth the requirements to be followed by the Oneida
Business Committee and the Oneida fund units when preparing the budget to be presented to the
General Tribal Council for approval, and establishes financial policies and procedures for the
Nation which:
 institutionalize best practices in financial management to guide decision makers in making
informed decisions regarding the provision of services, implementation of business plans
for enterprises, investments, and capital assets;
 provide a long term financial prospective and strategic intent, linking budget allocations to
organizational goals, as well as providing fiscal controls and accountability for results and
outcomes;
 identify and communicate to the membership of the Nation spending decisions for the
government function, grant obligations, enterprises, membership mandates, capital
expenditures, technology projects, and capital improvement projects;
 establish a framework for effective financial risk management; and
 encourage participation by the Nation’s membership. [1 O.C. 121.1-1].
The Nation is required to develop, adopt, and manage an annual budget. [1 O.C. 121.5-1]. All
revenues and expenditures of the Nation shall be in accordance with the annual budget. Id. The
Nation’s annual budget is required to be a balanced budget, which does not propose to spend more
funds than are reasonably expected to become available to the Nation during that fiscal year. [1
O.C. 121.5-1(a)]. Underwriting debt resources or the utilization of existing debt instruments shall
be expressly prohibited from use to balance the Nation’s annual budget. [1 O.C. 121.5-1(a)/(1)].
Assets of the Nation shall not be divested, or borrowed against, to balance the annual budget. [1
O.C. 121.6-8]. The Budget and Finances law provides for the process and procedures to be used
for the development and adoption of the Nation’s budget. [1 O.C. 121.5-4].
This resolution provides that at the conclusion of each fiscal year there are revenues earned that
exceed expenditures which result in “carry over funds” which are available only once they are
audited, and are allocated accordance with General Tribal Council directives which require twentyfive percent (25%) of carry over funds from each fiscal year to be allocated to land acquisition in

accordance with the 2033 Land Acquisition Plan, as utilized to balance budgets, or as authorized
by the Oneida Business Committee for specific projects which could occur by motion or by
resolution.
In October of 2022 the Oneida Business Committee adopted resolution BC-10-21-22-A, Process
to Authorize Use of Carry Over Funds, which requires that use of carry over funds be authorized
by adoption of a resolution by the Oneida Business Committee which states the amount to be
authorized, the purpose of the fund request, and identifies the remaining balance of carry over
funds.
Through this resolution the Oneida Business Committee authorizes the use of one hundred fifty
thousand dollars ($150,000) to fund the Norbert Hill Center and Oneida Tribal School Sign
Replacement.1 The balance of carry over remaining after this use of funds is thirty-nine million
six hundred twenty-four thousand dollars ($39,624,000).
Conclusion
Adoption of this resolution would not conflict with any of the Nation’s laws.

The NOW THEREFORE BE IT RESOLVED section provides that the use of these carryover funds is to fund the
Norbert Hill Center and Oneida Tribal School Sign Replacement. The WHEREAS section on line 33 provides that
this is a request to use one hundred fifty thousand ($150,000) to fund an endowment fund for the Norbert Hill Center
and Oneida Tribal School Sign Replacement. If this is actually funding an endowment fund, then compliance with the
Endowments law would need to occur. Due to the fact that an endowment is not mentioned in the Resolved section of
this resolution– an analysis for compliance with the Endowments law is not included in this statement of effect since
the appropriate information is not included.

EASEMENT RULE EMERGENCY AMENDMENT

Land Management currently seeks use of the Emergency Amendment to the Easement Rule using
the Administrative Rulemaking law section 106.10, an allowance for emergency action to be put
in place while an amendment goes through the legislative process.
There is a need to revise the application and processing fee language of the easement rule to
accommodate for Oneida initiated developments and prior Oneida initiated developments that
did not incorporate easements as part of their project. Currently, the rule does not allow for
any exception to application and processing fees.
Most of these development projects are/were prioritized on trust lands. On fee property there
are easements created by state statute (Wis. Stat. Chapter 236) through proper adoption of Plats
of Survey or Certified Survey Maps. When a developer contacts the utility company those
easements have already been dedicated for them to come in and lay their lines at no cost to
them. In fact, the owner or developer will pay the utility company to bring the needed utility
infrastructure for the benefit of the project end users. There is no similar federal law that mimics
this process and therefore all easements need to be processed through written easement
documents and approved by the Bureau of Indian Affairs on trust land.
The amendment should allow for a waiver of application and processing fees for utility providers
servicing the land of a tribal member or the Nation, regardless of land status. This amendment
is needed on an emergency basis to prevent stalling development projects in process. Cattail
Marsh is meant to support the Home Builder Opportunity (HBO) program. HBO provides
residential leasing sites for tribal member development. Another impact is the Rolling Hills sewer
and water infrastructure extension of our current Oneida Nation municipal system. The Rolling
Hills project is meant to address failing septic systems and enhance our existing water system.
There is a continuing need to complete land title clean up work (easement processing) for a
majority of our existing tribal developments.
Oneida Intergovenmental Affairs also does support the need for the emergency amendment, as
the current rules have complicated relationships with local governments and entities (and their
vendors) that the Nation has cooperative governance agreements with.
