Targeted Brownfields Assessment (TBA)
Application

EPA Region 8 accepts applications for environmental assessment assistance at brownfields
properties on an ongoing basis. To request Region 8’s technical assistance, please complete
this application. The information provided will be evaluated to determine if the applicant and
site meet the selection criteria for the TBA program. EPA will also evaluate whether funding is
available to perform the requested assessment within the desired schedule. Applicants will be
contacted promptly after this review. For more information on TBAs, please visit:

A. Please provide a brief description of the property and the specific
assessment(s) you wish to have performed (e.g., Phase I, II and/or cleanup
planning):

We would like to have a Phase I and Phase II performed on this site. The property is
approximately 2 acres of land located to the south of the Flandreau Indian School. The
property is located at an intersection and is adjacent to an open lot. The outside of the
church has lead-based paint on it that is chipping away and falling onto the ground. Inside
of the church there is mold and asbestos possibly. Upon further investigation the mold
problem was discovered to be significant. Possibly black mold and foundation unstable. An
assessment was found the outside paint to have lead beyond the limits. There are school
children around the premises.

B. When you would like the assessment(s) to be conducted? What is the project timeline?

We would like the assessment of this site to be completed immediately. Contract is ready to be
executed.
C. Why would you like the assessment(s) conducted? (TBAs can be used to facilitate
property acquisitions, meet EPA grant application requirements, characterize
contamination for environmental cleanup, among other reasons.)

We would like the assessments to be completed by EPA. The reason is for thoroughness and with the
intent of having the site done completely to EPA standards. The Executive Counsel of the Flandreau
Santee Sioux Tribe would also like EPA to conduct the assessments.

D. Describe the environmental conditions at the site, including potential
contaminates and a summary of any known past environmental investigations.
Describe the past uses of the site.

This site has lead based paint on the outside of the building. It contains asbestos inside of
the church and also has significant mold damage inside. This site was being used by the
Flandreau Indian School for church purposes for the children. It was found the church
contains empty barrels of contents unknown and empty buckets of paint.

conduct the site assessment activities? (Yes/No) Note: Applicant will be
required to secure access. Yes

G. Do you know how and when the contamination occurred? (Yes/No) If yes,
describe. Note: Applicants who are responsible for causing contamination are
not eligible for assistance under this program.

No — It is believed the church was abandoned due to the mold smell and animal infestation.

It was also being used by kids of the community and vandalized. Drinking, drug use, and

partying are some of the activities found to be happening inside of the church. Lead was

discovered in the paint and this paint is flaking off of the building.

environmental condition.

3. Property Reuse and Redevelopment

A. Describe the anticipated reuse or redevelopment of the property.

The anticipated use of this property is to build a Vo-tech near the Flandreau Indian School.

B. Describe any commitments in place to show this brownfields site will be cleaned
up and redeveloped or reused. Please indicate potential or secured funding sources for

cleanup and redevelopment.

Brownfields will clean up the site, as long as EPA says the cleanup can happen.
C. Describe how site reuse/redevelopment will benefit the community (e.g.,
creation of jobs, green space, parks, sustainable/green redevelopment, a
catalyst for further redevelopment in the area, etc). Privately owned sites must
provide a substantial public benefit.

The site will be used for educational purposes with intent to place a vo-tech on the site. It
will benefit the Flandreau Santee Sioux Tribe’s children as well as surrounding communities
and other tribes. It will also help with economic development and jobs for the community.

D. Will the property be sold or transferred to a different entity? If so, please
describe. No

E. Describe the roles of stakeholders in the project, e.g., community
organizations, local government involvement, etc.

Flandreau Santee Sioux Tribe is planning to have a Vo-tech built on this property for the
educational purposes of the tribe and surrounding communities.

F. Describe efforts directed towards involving the community in site reuse
planning activities.

We are making community awareness of possible Vo-tech education through the general
counsel meetings, as well as public meetings, and use of the newsletters.

*The Brownfields Law outlines specific criteria by which petroleum sites may be eligible for brownfields
funding. Briefly, these criteria are that the site must be of “relatively low risk,” there can be no viable
responsible party, the applicant cannot be potentially liable for cleaning up the site, and the site must not be
subject to a Resource Conservation and Recovery Act (RCRA) corrective action order. If a party is identified
as being responsible for the site and that party is financially viable, then the site is not eligible for brownfields

In reviewing my files I noted that the Episcopal Bishop wrote to you on June 28, 2001,
regarding the above referenced matter. I am enclosing a copy of that letter for your
review. As of the above date I have nor has the Bishop received written confirmation

that the above listed property has been removed from the National Register of Historic
Places.

I am also enclosing a copy of the minutes from the August 3, 2001, Diocesan Council in
which I have highlighted the relevant section that denies the request to place the property
on the National Register and therefore you must remove it from the same.

First, let me introduce myself. My name is Anthony Firman, and I have had:
the distinct privilege to-serve as Chaplain/Religious Coordinator for the
Flandreau indian School since 1966. I am writing to you on the advice of
Mrs. Ardyee Samp of Flandreau, South Dakota. I would like to recommend
for consideration of the Historical Society the addition of the F landreau
Indian School Student Chapel, originally known as St. Mary’s Episcopal
Church. This building was constructed in 18°79 and is.an historical treasure,
in my opinion. Since 1971 it has been in use as the Flandreau Indian School
Student Chapel. The original Episcopal congregation moved down town
merging with the Redeemer Church to become St. Mary’s/Redeemer
Congrégation. The building is pretty much in its original condition, and is
located at the main entrance on North.Crescent Street to the Flandrean
Indian School. Last year we installed the third roof since it has been in use
as the school chapel. Over all, the building is in very good condition.

I hepe that you will let us know what we need to-do to protect this historic
land mark that has served the Native American Episcopal-Community for
almost a hundred years before it was closed and turned over to the Indian

School Chaplaincy program.

| am in receipt of your letter dated June 18, 2001, concerning the placement of the old St. Mary's
Church building on the National Register of Historic Places.

| was surprised to hear that such action was being considered by the State Historical Society
Board of Trustees. | do not recall this matter coming before the Diocesan Council of the
Episcopal Diocese, which body is charged with making such property decisions concerning all

land owned by the Episcopal Church, and held by the Chapter of Calvary Cathedral, a holding
company for all church land.

Since Diocesan approval is necessary for requests of this nature, | will place this matter on the
agenda of the Diocesan Council meeting scheduled for August 3-4, 2001, in Sioux Falls. Absent
the action of the Diocesan Council, | will need to object to, and this letter serves as our objection,

| am sorry to inform you of our objection at this time, however, any and all decisions concerning
diocesan property need to have the approval of the Diocesan Council. {| will jet you know of
council's action following the August meeting.

Thank you for your concerns regarding St. Mary’s Episcopal Church in
Flandreau, Moody County, South Dakota.

The National Register nomination was presented to the South Dakota State
Review Board on July 20, 2001. Formally, the nomination was presented for a
Determination of Eligibility (DOE). A DOE is presented to the Review Board for
their voted. They determined that the building was Officially eligible for the
National Register of Historic Places. The DOE was then sent to the National
Park Service (NPS). This simply means that the State Historic Preservation
Office and the NPS agree that the building is eligible for placement of the
Nationa! Register of Historic Place. If the Diocese at any time decides that they

would like the building listed, the NPS has the information and can list the
building.

Officially, St. Mary’s Episcopal Church is not, nor was it ever, listed on the

National Register of Historic Places. The only action the building has is an
official DOE from the NPS dated September 14, 2001.

Verbal Boundary Description

Beginning at a point two rods South of the Northeast comer of the Northwest quarter of Section 21
and running thence South 12.5 rods thence West 12.5 rods thence North 12.5 rods, thence East 12.5
rods to the place of the beginning. All in Township 107 of Range 48.

Boundary Justification

The boundary includes all of the property that has historically been associated with the church.

I'm not sure where EPA is in the Section 106 process. I've gathered that compliance may not be done. | highly
recommend not tearing the church down until compliance is done and since the church is eligible. This means EPA
producing an MOA to mitigate the Adverse Effects. If the tribe owns the building you'll need work through the
Flandreau THPO, JB Weston. called and left amessage for him last week and haven't heard back. However, if the
applicant (the tribe) would like for the SHPO to participate in the process we can, but the THPO still needs the

opportunity to comment.

| will be out of the office tomorrow, but will available on Wednesday to answer any questions.
