INTRODUCTION

The Confederated Tribes of Coos, Lower Umpqua & Siuslaw Indians (CTCLUSI), hereinafter
referred to as the “Tribe,” are soliciting proposals from qualified and appropriately licensed
General Contractors for the renovation of existing building structures located at 92630 Cape
Arago Highway, Coos Bay, Oregon 97420.

The selected General Contractor will be responsible for coordinating and facilitating all activities
necessary to successfully complete the project. This includes providing overall project
management and coordination of all required subcontractors and trades, including, but not
limited to, electrical, mechanical, plumbing, and structural trades required to complete the work.

The purpose of this solicitation is to obtain competitive proposals from qualified General
Contractors with demonstrated experience successfully completing renovation and construction
projects of similar scope, size, complexity, and scale.

Proposals must be received by the Tribe no later than 5:00 PM on September 22nd, 2026.
Proposals received after the stated deadline may not be considered.

Proposals will be evaluated based on the criteria established in this RFP. The successful
Contractor will be selected and approved by the Tribe based on the proposal determined to
provide the best overall value and meet the needs of the project.

The Tribe reserves the right to reject any or all proposals, waive minor informalities or
irregularities, request clarification or additional information, negotiate with one or more
proposers, and select the Contractor and services determined to be in the best interest of the
Tribe. Issuance of this RFP does not obligate the Tribe to award a contract or reimburse any
proposer for costs incurred in preparing or submitting a proposal.

Proposals should be clearly marked with the Proposer’s name and address, as well as the
RFP Project title.

EVALUATION AND SELECTION CRITERIA

Proposals will be evaluated by CTCLUSI based on the criteria identified below. Proposers
should provide sufficient information within their proposal to allow the evaluation committee to
assess each criterion. The maximum possible score is 100 points.

1. Proposed Timeline to Completion — 30 Points

The Proposer shall provide a detailed proposed project schedule identifying the anticipated
start date, major construction activities and milestones, coordination of subcontractors and
trades, anticipated inspections, substantial completion, and final completion.

Evaluation will consider:

Reasonableness and feasibility of the proposed construction schedule.
Ability to mobilize and begin work in a timely manner.

Overall proposed time to complete the project.

Identification of major milestones and sequencing of work.

Coordination and scheduling of subcontractors and required trades.

Ability to manage potential scheduling constraints or delays.
Demonstrated ability to complete the project within the proposed schedule.

The proposed completion timeline must be clearly identified in the proposal.

Maximum Points: 30

2. Experience with Similar Projects — 20 Points

The Proposer shall demonstrate relevant experience successfully completing renovation and
construction projects of similar scope, size, complexity, and nature.

Evaluation will consider:

Experience with substantial building renovation and remodeling projects.

Experience coordinating electrical, plumbing, HVAC, structural, and other construction
trades.

Experience renovating existing residential, transitional housing, multifamily, commercial,
or similar facilities.

Experience managing projects involving existing or concealed building conditions.
Qualifications and experience of key personnel assigned to the project.

Demonstrated ability to successfully manage subcontractors, schedules, budgets,
inspections, and project closeout.

Quality and relevance of references and examples of previously completed projects.

Proposers should identify similar projects completed within the past five (5) years, including
the project name, location, description of work, contract amount, completion date, and
owner/reference contact information.

Maximum Points: 20

3. Price — 40 Points

The Proposer shall provide a complete proposed Contract Price for all labor, materials,
equipment, supervision, subcontractors, permits, inspections, overhead, profit, applicable
prevailing wage requirements, and all other costs necessary to provide a complete and fully
functional project as described in the RFP and Contract Documents.

Price will be evaluated based on:

e Total proposed Contract Price.

¢ Completeness and clarity of the proposed pricing.

e Reasonableness of the price in relation to the Scope of Work.

¢ Identification and explanation of any assumptions, exclusions, allowances, or
qualifications affecting the proposed price.

e Overall value to CTCLUSI.

The lowest-priced proposal will not necessarily be selected for award. CTCLUSI intends to
select the responsive and responsible Proposer whose proposal provides the best overall
value to the Tribe, considering price together with all other evaluation criteria.

Maximum Points: 40

4. Tribally Owned, Women-Owned, Veteran-Owned, and Minority-Owned Business — 10
Points

CTCLUSI encourages participation by Tribally Owned Businesses, Women-Owned
Businesses, Veteran-Owned Businesses, and Minority-Owned Businesses.

Proposers requesting consideration under this criterion shall clearly identify the applicable
business ownership classification in their proposal and provide documentation sufficient for
CTCLUSI to verify the claimed status.

Points will be awarded based upon the Proposer's demonstrated and verified qualification
under the applicable business preference or ownership categories established by CTCLUSI.

A Proposer that does not provide sufficient information or documentation to establish eligibility
may receive zero points under this criterion.

CTCLUSI reserves the right to consider proposal completeness and responsiveness,
contractor qualifications, references, proposed approach, and other relevant information
necessary to determine the Proposer's ability to successfully complete the project. CTCLUSI
may request clarification or additional information, verify references and qualifications, conduct
interviews, and negotiate with one or more Proposers prior to final selection.

PROPOSAL SUBMISSION REQUIREMENTS

Proposers shall submit a complete proposal containing sufficient information for CTCLUSI to
evaluate the Proposer's qualifications, experience, proposed approach, schedule, and price.
Proposals should be organized in the order presented below.

1. Cover Letter and Contractor Information
Provide a cover letter identifying:

Legal name of the General Contractor.

Business address, telephone number, and email address.

Primary contact person for the proposal.

Oregon Construction Contractors Board (CCB) license number.

Number of years the company has been in business.

Name and title of the individual authorized to bind the company.

Acknowledgment that the proposal will remain valid for ninety (90) calendar days
following the proposal due date.

2. Contractor Qualifications and Experience

Provide a summary of the Proposer's qualifications and experience demonstrating the ability to
successfully complete projects of similar scope, size, and complexity.

The proposal should include:

e General Contractor's relevant construction and renovation experience.

¢ Experience with residential, transitional housing, multifamily, commercial, or similar
renovation projects.

¢ Experience coordinating electrical, plumbing, HVAC, structural, and other
subcontractors and trades.

¢ Qualifications and experience of the Project Manager, Superintendent, and other key
personnel proposed for the project.

e Description of the Proposer's ability and capacity to complete the project within the
proposed schedule.

3. Similar Project Experience and References

Provide information for at least three (3) similar projects completed within the past five (5)
years, when available.

For each project, provide:

Project name and location.

Owner/client.

Description and scope of work.

Original and final contract amount.

Construction start and completion dates.

Explanation of significant change orders or schedule delays, if applicable.
Owner/client contact name, telephone number, and email address.

CTCLUSI reserves the right to contact references and independently verify information
provided by the Proposer.

4. Project Approach

Provide a brief description of the Proposer's proposed approach to completing the project,
including:

Overall construction and project management approach.

Coordination and supervision of subcontractors and trades.

Approach to demolition and renovation of existing structures.

Management of concealed or unforeseen conditions.

Quality-control procedures.

Site safety and security.

Protection of existing structures and areas excluded from the Scope of Work.
Coordination with CTCLUSI staff, inspectors, utilities, and Authorities Having
Jurisdiction.

Approach to project closeout, punch-list completion, warranties, and final acceptance.

5. Proposed Project Schedule

Provide a detailed proposed construction schedule identifying, at minimum:

Anticipated mobilization/start date.
Major construction phases.
Demolition.

Structural repairs, as applicable.
Electrical, plumbing, and HVAC work.
Interior construction and finishes.
Required inspections.

Substantial completion.

Punch-list completion.

Final completion and turnover.

Construction Schedule and Look-Ahead: The Contractor shall provide CTCLUSI with an
initial project schedule prior to the start of construction and maintain an updated two- to threeweek look-ahead schedule throughout the remodel process. The Contractor shall submit the
updated two- to three-week look-ahead schedule electronically to the CTCLUS! Planning
Department at ajames@ctclusi.org throughout the remodel process. The look-ahead
schedule shall identify anticipated work activities, sequencing, subcontractor activities,
inspections, material deliveries, utility coordination, and any known or anticipated delays that
may affect the project schedule or completion date.

The Proposer shall clearly identify the total anticipated number of calendar days required
to complete the project.

6. Subcontractors and Key Trades

Identify known or anticipated major subcontractors and trades proposed for the project,
including, as applicable:

Electrical.

Plumbing.

HVAC/mechanical.

Structural.

Roofing.

Other major construction trades.

If subcontractors have not been selected at the time of proposal, the Proposer shall identify the
anticipated subcontracted work and describe its process for selecting qualified and
appropriately licensed subcontractors.

The General Contractor shall remain fully responsible for the performance, coordination,
supervision, and compliance of all subcontractors and lower-tier subcontractors.

7. Proposed Contract Price
Provide a complete proposed Contract Price for completion of the Scope of Work.

The proposed price shall include all costs necessary to provide a complete and fully functional
project, including, but not limited to:

Labor.

Materials and equipment.
Subcontractors.

Supervision and project management.
Mobilization.

Permits and inspections.

General conditions.

Overhead and profit.

Applicable taxes and fees.

Davis-Bacon prevailing wages and fringe benefits.
Certified payroll and other federal labor compliance costs.
Cleanup and disposal.

Warranties and project closeout.

The Proposer shall clearly identify any allowances, assumptions, exclusions,
qualifications, or items not included in the proposed Contract Price.

8. Davis-Bacon and Federal Requirements

The Proposer shall acknowledge that the project is subject to applicable Davis-Bacon and
Related Acts prevailing wage requirements and that the proposed Contract Price includes
the costs associated with compliance.

The selected Contractor and applicable subcontractors shall be responsible for complying with
the federal labor standards and certified payroll requirements contained in this RFP and the
resulting Contract Documents.

9. Business Ownership/Preference Information

Proposers requesting evaluation points as a Tribally Owned Business, Women-Owned
Business, Veteran-Owned Business, or Minority-Owned Business shall identify the
applicable ownership classification and provide documentation sufficient for CTCLUSI to verify
eligibility.

Failure to provide sufficient supporting documentation may result in no points being awarded
under this evaluation criterion.

10. Addenda Acknowledgment

The Proposer shall acknowledge receipt of all Addenda issued by CTCLUSI for this
solicitation.

Failure to acknowledge a material Addendum may result in the proposal being determined
non-responsive.

11. Exceptions, Assumptions, and Deviations
The Proposer shall clearly identify any exceptions, proposed modifications, assumptions,
qualifications, or deviations from the RFP, Scope of Work, attachments, or proposed Contract

requirements.

Any requirement for which an exception is not specifically identified in the proposal may be
considered accepted by the Proposer.

CTCLUSI reserves the right to determine whether an identified exception or deviation is
acceptable.

12. Required Certifications and Documentation
The Proposer shall provide, as applicable:

Current Oregon CCB license information.

Required business licenses.

Evidence of ability to meet CTCLUSI's insurance requirements.
Required debarment and suspension certification.

Required federal certifications and representations.

Business ownership/preference documentation, if applicable.

Any other forms or certifications identified in the RFP or its attachments.

Proposal Responsiveness

Proposers are responsible for submitting all information necessary for CTCLUSI to evaluate
their proposal. CTCLUSI may determine a proposal to be non-responsive if material
information required by the RFP is omitted.

CTCLUSI] reserves the right to waive minor informalities or irregularities, request clarification or

supplemental information, verify information submitted, and determine whether a proposal
substantially complies with the requirements of this RFP.

1.1 MANDATORY PRE-PROPOSAL WALKTHROUGH

A Mandatory Pre-Proposal Walkthrough will be held on September 9th, 2026, at 9:00 AM at:

All General Contractors intending to submit a proposal are required to attend the walkthrough.
The purpose of the walkthrough is to provide prospective Proposers an opportunity to inspect

the existing buildings and site conditions and become familiar with the nature and extent of the
Work.

Proposers are responsible for reviewing reasonably observable existing conditions, site
access, utilities, building conditions, and other factors that may affect the cost, schedule, or
performance of the Work.

Questions arising from the walkthrough shall be submitted in writing to the RFP Contact no
later than 5pm on September 15, 2026. Any clarification or change that materially affects the
RFP or Scope of Work will be issued by CTCLUSI through a written Addendum.

Failure to attend the Mandatory Pre-Proposal Walkthrough may result in the Proposer's
proposal being deemed non-responsive and not considered for award.

1.2 CHANGES TO RFP

Any change or clarification of the Scope of Work, procurement process, contract terms and
conditions, insurance requirements or any other matter contained in this RFP will be issued in
the form of a written Addendum to this RFP. CTCLUSI will make a good faith effort to notify
interested parties of any addenda issued for this RFP. However, it is the responsibility of all
parties interested in this or any other CTCLUSI contract opportunity to regularly check for any
addenda that may have been issued. This includes staying informed of any updates or
changes up until the solicitation closing time.

2. PROJECT OVERVIEW

Project: Complex Building Remodel
Location: 92630 Cape Arago Hwy Coos Bay, Oregon
Owner: Confederated Tribes of Coos, Lower Umpqua & Siuslaw Indians (CTCLUSI)

The purpose of this project is to renovate the existing structures into safe, functional, durable,
and code-compliant transitional housing facilities. The project will require extensive renovation
of the existing units, correction of existing deficiencies, and replacement or installation of
building systems, fixtures, equipment, and finishes as necessary to provide fully functional
residential and support spaces.

The completed facility will generally consist of:

Six (6) living units each with a full kitchen and full bathroom.
One (1) laundry room, kitchen and restroom only.

One (1) meeting room, Three (3) offices and a restroom only.
One (1) fully enclosed kennel area located at the end of Unit #7.

The General Contractor shall provide all labor, materials, equipment, supervision,
subcontractors, coordination, permitting, inspections, temporary facilities, cleanup, and other

services necessary to provide a complete and fully functional project in accordance with the
Contract Documents and all applicable federal, state, and local codes and requirements.

Project Exclusion — Unit #4

Unit #4 is specifically excluded from the scope of work under this RFP. No remodeling,
renovation, demolition, construction, or other work shall be performed within Unit #4 unless
specifically authorized in writing by CTCLUSI.

The Contractor shall take appropriate precautions to protect Unit #4 from damage, dust,
debris, construction activities, and unauthorized access throughout the project.

Kennel Enclosure — End of Unit #7

The Contractor shall provide and install a fully enclosed kennel within the existing area at the
end of Unit #7. The kennel shall be designed and constructed to provide a secure, durable,
weather-resistant, and safe outdoor enclosure suitable for containing dogs. The Contractor
shall provide all labor, materials, hardware, gates, fasteners, and other components necessary
for a complete and functional kennel enclosure.

The kennel enclosure shall include:

e Provide a fully enclosed kennel suitable for animal containment.

¢ Enclosure shall prevent animals from escaping over, under, or through the kennel.

e Provide a secure, lockable access gate.

e Include all fencing, posts, anchors, fasteners, hardware, and materials required for
complete installation.

e Final size, layout, and location shall be coordinated with and approved by CTCLUSI.

2.1 Permits and Inspections

The General Contractor shall be responsible for coordinating, obtaining, and purchasing all
permits, licenses, approvals, and inspections required to complete the entire project.

This responsibility includes all permits required for work performed by the General Contractor
and its subcontractors, including, but not limited to:

Building permits

Electrical permits

Plumbing permits

Mechanical permits

Demolition permits, if applicable

State, County, and/or City permits and approvals

Any other permits, inspections, or approvals required by the applicable Authority Having
Jurisdiction.

The General Contractor shall coordinate with all subcontractors to ensure required trade
permits are obtained prior to beginning the applicable work.

All permit, plan review, inspection, and associated fees shall be included in the Contractor's
total contract price unless specifically identified otherwise in the Contract Documents.

HAZARDOUS MATERIALS — ASBESTOS, LEAD, AND OTHER HAZARDOUS MATERIALS

The Contractor shall comply with all applicable federal, state, and local laws, regulations, and
requirements governing asbestos-containing materials (ACM), lead-based paint (LBP), and
other hazardous or regulated materials encountered during performance of the Work.

Known Hazardous Materials: CTCLUSI will provide the Contractor with any available asbestos,
lead, hazardous materials surveys, reports, or other relevant information in CTCLUSI's
possession pertaining to the project site.

Suspected or Previously Undisclosed Hazardous Materials: If the Contractor encounters or
reasonably suspects asbestos-containing materials, lead-based paint, mold requiring regulated
remediation, contaminated materials, or other hazardous or regulated substances that were
not identified in the Contract Documents, the Contractor shall immediately:

Stop work in the affected area;

Secure and protect the affected area from disturbance:

Notify CTCLUSI's designated Project Representative; and

Not disturb, remove, handle, transport, or dispose of the suspected material until
authorized to proceed.

PONS

CTCLUSI will determine, in consultation with qualified professionals as appropriate, whether
testing, assessment, abatement, remediation, or other action is required.

Unless specifically included in the Scope of Work and the Contractor's proposed Contract
Price, testing, abatement, remediation, removal, transportation, and disposal of previously
unidentified hazardous materials shall not be considered part of the Contractor's original
Contract Price. Any additional work or associated costs shall require prior written authorization
from CTCLUSI in accordance with the Contract's Change Order procedures.

The Contractor shall not perform asbestos or other regulated hazardous-material abatement
unless properly licensed, certified, and authorized to perform such work. When abatement is
included or subsequently authorized, the Contractor shall ensure that all work is performed by
appropriately licensed or certified personnel and in accordance with all applicable regulatory
requirements. ,

The Contractor remains responsible for hazardous substances, spills, releases, or
contamination introduced or caused by the Contractor, its employees, subcontractors,
suppliers, or agents during performance of the Work.

2.2 DEMOLITION

The project includes a substantial interior remodel of the designated units. Unless otherwise
indicated in the construction documents, the Contractor should anticipate demolition of existing
interior finishes and components as necessary to expose the existing framing and building
systems.

Work may include:

Removal of existing wall finishes.

Removal of existing flooring.

Removal of existing cabinetry and countertops.

Removal of existing plumbing fixtures as required.

Removal of existing electrical components and wiring being replaced.
Removal of existing appliances.

Removal of damaged, deteriorated, or unusable materials.

Proper disposal of demolition and construction debris.

2.3 EXISTING DAMAGE AND STRUCTURAL REPAIRS

Following demolition, the Contractor shall inspect exposed areas for existing deterioration, rot,
water damage, pest damage, damaged framing, or other concealed conditions.

The Contractor shall repair or replace damaged building components as required to provide a
structurally sound and code compliant finished product.

Any significant concealed conditions discovered after demolition that are outside the
reasonably anticipated Scope of Work shall be documented and brought to CTCLUSI's
attention before additional work is performed.

No additional work resulting in an increase to the Contract Price shall proceed without prior
written authorization from CTCLUSI through the proper Change Order process.

2.4 ELECTRICAL
The project includes new electrical systems within each unit.
The Contractor shall coordinate and provide all required electrical work, including:

« Electrical Utility Upgrade: CTCLUSI will coordinate and contract directly with Pacific
Power for the required utility upgrade to provide 120/240-volt, single-phase electrical
service. The Contractor shall be responsible for all electrical service work from the
existing utility pole to each unit being upgraded, including all necessary materials,
equipment, connections, installation, permitting, inspections, and coordination required
to provide a complete and operational electrical service to each unit.

e New electrical wiring throughout each unit.

¢ Electrical panels and breakers as required.

e New receptacles and switches.

e Energy-efficient interior and exterior LED lighting using standard, cost-effective,
commercially available fixtures. Fixtures shall prioritize energy efficiency, durability,
ease of replacement, and affordability. Decorative, specialty, designer, or premiumgrade fixtures are not required unless specifically identified in the Contract Documents
or approved by the Owner.

Dedicated circuits for appliances and mechanical equipment.

GFCI and AFCI protection as required by code.

Smoke and carbon monoxide detection as required by code.

Required grounding and bonding.

Electrical permits, inspections, and coordination required for completion of the work.

All electrical work shall be performed by properly licensed electrical contractors and shall
comply with all applicable current Federal, State, County, utility, and electrical code
requirements.

2.5 PLUMBING

The Contractor shall provide new and/or modified plumbing systems as required for each unit,
including:

Kitchen plumbing.

Bathroom plumbing.

Waste and vent piping.

Plumbing fixtures and connections.
Shutoff valves.

Connections to existing utilities.
Plumbing permits and inspections.

Existing plumbing found to be damaged, deteriorated, or unsuitable for reuse shall be identified
and addressed as part of the project.

2.6 HVAC
Each unit will receive an appropriate heating and ventilation system fit for that space.

Work shall include all required equipment, electrical connections and controls necessary to
provide a complete and operational HVAC system in each unit.

2.7 INTERIOR CONSTRUCTION AND FINISHES

Following completion of demolition, repairs, and rough in work, the Contractor shall reconstruct
and finish the units.

Work includes:

e Framing and framing repairs.

Insulation.

Drywall and wall finishes.

Interior painting.

New flooring and associated underlayment.
Baseboards and trim.

Interior and exterior doors as required.
Door hardware.

Kitchen cabinetry.

Kitchen countertops.

Toilets, showers and sink vanities.
Bathroom finishes and accessories.
Closets.

Other finishes necessary to provide complete, move in ready units.

2.8 KITCHENS AND APPLIANCES
Each unit shall receive a complete and functional kitchen.
The work will include installation of:

Kitchen cabinets.

e Countertops.

e Kitchen sink and faucet.

e Required plumbing connections.
e Required electrical connections.
e Range/oven/hood

e Refrigerator.

2.9 PERMITS AND INSPECTIONS

The General Contractor shall be responsible for coordinating and scheduling all required
permits and inspections associated with the project.

This includes coordination with Coos County, State, utility, and other authorities having
jurisdiction.

The Contractor shall ensure that all required inspections are completed and approved and that
applicable permits are properly finalized prior to project closeout.

2.10 PROJECT COMPLETION
The intent of this RFP is to obtain a complete, turnkey remodel of the designated units.

Upon completion, each renovated unit shall be clean, safe, code compliant, fully operational,
and ready for occupancy.

The Contractor shall complete all punch-list items, remove construction debris, perform final
cleaning, provide required warranties and closeout documentation, and obtain all required final
approvals before requesting final acceptance by CTCLUSI.

3. SCHEDULE
Key milestones:

RFP Issued: August 24th, 2026

Mandatory Walkthrough September 9", 2026 at 9am
Questions (RFIs) Due: September 15", 2026 by 5pm
Final Addendum September 17‘, 2026

Proposals Due: September 22nd, 2026 no later than 5pm

Proposers shall include a detailed project schedule with their submission.

4. INSURANCE REQUIREMENTS
The selected firm must provide proof of:

e General Liability Insurance
e Professional Liability Insurance
e Workers’ Compensation Insurance
CTCLUSI shall be named as an additional insured.

5. DAVIS-BACON AND PREVAILING WAGE REQUIREMENTS

This project is subject to applicable Davis-Bacon and Related Acts (DBRA) prevailing wage
requirements. The project consists of the renovation of an existing seven-unit attached
residential structure and shall be considered Residential Construction for purposes of the
applicable Davis-Bacon wage determination, subject to confirmation by the funding.

The Contractor and all subcontractors and lower-tier subcontractors shall comply with all
applicable Davis-Bacon and Related Acts requirements and federal labor standards for the
duration of the project.

5.1 Applicable Wage Determination

The applicable U.S. Department of Labor Davis-Bacon Residential Construction Wage
Determination for Coos County, Oregon will be included as an attachment C to this RFP and
incorporated into the Contract Documents.

The applicable wage determination establishes minimum wage rates and fringe benefits for
covered labor classifications performing work on the project.

Proposers shall review the applicable wage determination prior to submitting a proposal and
shall include all labor, fringe benefit, administrative, and other costs associated with Davis
Bacon compliance in their proposed Contract Price.

5.2 CONTRACTOR REQUIREMENTS

The Contractor shall be responsible for compliance with all applicable Davis-Bacon
requirements, including, but not limited to:

Payment of applicable prevailing wage rates and fringe benefits.

Proper classification of workers based on the work actually performed.

Payment of covered workers in accordance with applicable federal requirements.

Maintenance of required payroll and employment records.

Submission of weekly certified payroll records for all weeks in which work is performed.

Submission of required Statements of Compliance with certified payrolls.

Compliance with applicable overtime requirements.

Posting the applicable Davis Bacon wage determination and required federal labor

notices at the project site in a location accessible to workers.

¢ Cooperation with any required employee interviews, payroll reviews, audits, or other
compliance monitoring.

¢ Correction and payment of any wage or fringe benefit underpayments identified during
the project.

¢ Compliance with all other applicable federal labor standards associated with the funding

of the project.

5.3 SUBCONTRACTOR COMPLIANCE

The General Contractor shall be responsible for ensuring that all subcontractors and lower-tier
subcontractors performing covered work comply with applicable Davis-Bacon requirements.

Applicable Davis-Bacon labor standards requirements and wage determinations shall be
incorporated into subcontracts as required.

The General Contractor shall be responsible for collecting and reviewing required certified
payroll documentation from its subcontractors and providing such documentation to CTCLUSI
or the applicable administering agency as required.

5.4 WAGE CLASSIFICATIONS

Workers shall be paid according to the classification applicable to the work they perform.

If work necessary for completion of the project is performed by a labor classification that is not
included in the applicable wage determination, the Contractor shall notify CTCLUSI and follow

the applicable U.S. Department of Labor process for requesting an additional classification and
wage rate.

The Contractor shall not independently establish or substitute a wage rate for an unlisted
classification without required approval.

5.5 PROPOSAL PRICE

The Contractor's proposal shall include all costs necessary to comply with applicable Davis-
Bacon and federal labor standards requirements.

No additional compensation will be provided solely because the Contractor or a subcontractor
failed to account for applicable prevailing wages, fringe benefits, certified payroll
administration, or other known Davis-Bacon compliance requirements when preparing its
proposal.

5.6 REQUIRED ATTACHMENT

The following shall be included with and incorporated into the RFP and resulting Contract
Documents:

Attachment C — U.S. Department of Labor Davis-Bacon Residential Construction Wage
Determination — Coos County, Oregon

The applicable wage determination shall be the determination required for the project under
the applicable federal funding requirements. CTCLUSI reserves the right to issue an
Addendum incorporating an updated or corrected wage determination when required by the
law, regulation, or funding source requirements.

CONTRACT AND GENERAL REQUIREMENTS

1. CONTRACTOR LICENSING

The General Contractor and all subcontractors shall maintain all licenses, registrations,
certifications, and permits required by federal, state, Tribal, and local law for the work being
performed.

The General Contractor shall maintain a current and valid Oregon Construction Contractors
Board (CCB) license throughout the duration of the project and shall provide its CCB license
number with its proposal.

The Contractor shall be responsible for ensuring that all subcontractors performing electrical,
plumbing, mechanical, or other licensed trade work are properly licensed and qualified to
perform the applicable work.

2. PERFORMANCE AND PAYMENT BONDS

If required by CTCLUSI or the applicable funding source, the selected Contractor shall
provide Performance and Payment Bonds in the amount required by the Contract Documents
or applicable law.

When required, bonds shall be provided by a surety authorized to conduct business in Oregon
and acceptable to CTCLUSI. The cost of required bonds shall be included in the Contractor's
proposed Contract Price.

The selected Contractor shall provide required bonds prior to commencement of construction
and within the time specified by CTCLUSI.

3. DEBARMENT AND SUSPENSION
The Contractor represents and certifies that neither the Contractor nor its principals are
presently debarred, suspended, proposed for debarment, declared ineligible, or otherwise

excluded from participation in federally funded transactions.

When federal funding requirements apply, the Contractor shall verify the eligibility of
subcontractors and other covered participants as required by applicable federal regulations.

The Contractor shall immediately notify CTCLUS if its eligibility status, or that of a covered
subcontractor, changes during the Contract period.

CTCLUSI reserves the right to verify debarment and suspension status prior to Contract award
and throughout the Contract period.

4. FEDERAL FUNDING REQUIREMENTS
This project may be funded, in whole or in part, with federal funds. The Contractor and its

subcontractors shall comply with all federal laws, regulations, grant conditions, and contractual
requirements applicable to the funding source.

Applicable federal requirements, certifications, clauses, and conditions identified by CTCLUSI
shall be incorporated into the resulting Contract and, when required, applicable subcontracts.

In the event of a conflict between the Contractor's standard terms and a mandatory federal
funding requirement, the applicable federal requirement shall control to the extent required by
law or the funding award.

The Contractor shall maintain documentation necessary to demonstrate compliance and shall
cooperate with CTCLUSI and applicable funding or oversight agencies regarding monitoring,
audits, inspections, and records requests.

5. TRIBAL AND BUSINESS PREFERENCE

CTCLUSI encourages participation by qualified Tribal, Native American, minority-owned,
women-owned, and veteran-owned businesses, consistent with applicable CTCLUSI
policies and funding requirements.

Proposers requesting preference or evaluation points shall provide sufficient documentation
with their proposal to establish eligibility.

The Contractor is encouraged to provide meaningful opportunities for qualified Tribal and other
preference-eligible subcontractors and suppliers when subcontracting opportunities are
available.

Any preference shall be applied in accordance with applicable CTCLUSI policy and the
requirements of the funding source.

6. BACKGROUND CHECKS AND SITE ACCESS

The Contractor shall be responsible for the conduct of its employees, subcontractors,
suppliers, and other personnel while on CTCLUSI property.

When required by CTCLUSI based upon the location, nature of the work, access to occupied
facilities, or applicable Tribal policy, Contractor personnel may be required to successfully
complete background screening or other access requirements before being permitted access
to the project site.

The Contractor shall comply with ail CTCLUSI security, identification, access, confidentiality,
and site-specific requirements communicated to the Contractor.

CTCLUSI reserves the right to deny or revoke site access to any individual when reasonably
necessary for safety, security, compliance, or protection of Tribal property, employees, clients,
residents, or the public.

7. SAFETY AND OSHA COMPLIANCE

The General Contractor shall be solely responsible for construction means, methods,
techniques, sequences, procedures, and job-site safety associated with performance of the
Work.

The Contractor shall comply with all applicable federal and Oregon occupational safety and
health requirements, including applicable OSHA and Oregon OSHA requirements.

The Contractor shall:

Maintain a safe and orderly construction site.

Provide appropriate personal protective equipment.

Provide required barriers, barricades, signage, and fall protection.

Maintain appropriate fire and emergency protections.

Protect CTCLUSI employees, residents, visitors, and the public from construction

hazards.

¢ Immediately report serious accidents, injuries, property damage, or significant safety
incidents to CTCLUSI. .

e Correct unsafe conditions promptly.

CTCLUSI's observation or inspection of the Work shall not relieve the Contractor of
responsibility for job-site safety.

8. SUBCONTRACTOR RESPONSIBILITY

The General Contractor shall be fully responsible to CTCLUSI for the performance of all
subcontractors and lower-tier subcontractors.

The Contractor shall coordinate, supervise, and manage all subcontractors and shall ensure
that subcontractors:

Are appropriately licensed and qualified.

Maintain required insurance.

Comply with applicable safety requirements.

Comply with Davis-Bacon and other applicable federal requirements.
Obtain required trade permits and inspections.

Comply with the Contract Documents and project schedule.

No subcontract between the General Contractor and a subcontractor shall create a contractual
relationship between CTCLUSI and the subcontractor.

The General Contractor shall remain responsible for all Work regardless of whether the Work
is performed directly by the Contractor or by a subcontractor.

9. WARRANTIES

Unless a longer warranty is required by the Contract Documents, manufacturer, or applicable
law, the Contractor shall warrant its workmanship for a minimum period of one (1) year
following final acceptance by CTCLUSI.

The Contractor shall provide CTCLUSI with all applicable manufacturer warranties, equipment
warranties, subcontractor warranties, operating manuals, maintenance information, and other
warranty documentation as part of project closeout.

The Contractor shall promptly correct defective or nonconforming Work identified during the
applicable warranty period when the condition is attributable to the Contractor's or
subcontractor's workmanship or materials.

10. CHANGE ORDERS

No change to the Scope of Work that increases or decreases the Contract Price or materially
affects the project schedule shall be performed without prior written authorization from
CTCLUSI.

When the Contractor believes additional work is necessary, the Contractor shall submit a
written Change Order request identifying:

Description and reason for the proposed change.
Detailed cost increase or decrease.

Labor and material costs.

Subcontractor costs.

Applicable overhead and profit.

Effect on the project schedule.

Supporting documentation requested by CTCLUSI.

Verbal authorization shall not constitute approval of a Change Order.

The Contractor proceeds with unauthorized additional work at its own risk and may not be
entitled to additional compensation or additional Contract time.

This supplements the RFP's existing requirement that additional work associated with
significant concealed conditions receive written authorization before proceeding.

11. PAYMENT AND RETAINAGE

Payments will be made based upon properly submitted invoices or Applications for Payment
for Work satisfactorily completed and accepted by CTCLUSI.

CTCLUSI may withhold retainage from progress payments in the amount established in the
resulting Contract and as permitted or required by applicable law and funding
requirements.

Payment does not constitute acceptance of defective, incomplete, or nonconforming Work.

Final payment, including release of applicable retainage, will be contingent upon satisfactory
completion and acceptance of the Work and receipt of all required closeout documentation.

12. INVOICING AND APPLICATIONS FOR PAYMENT

The Contractor shall submit invoices or Applications for Payment in the form and frequency
established by CTCLUSI.

Each payment request shall include sufficient documentation to substantiate the amount
requested and may include:

Contract amount.

Approved Change Orders.

Schedule of Values.

Work completed during the billing period.
Materials properly stored, when authorized.
Previous payments.

Current amount requested.

Retainage, if applicable.

Updated project schedule.

Certified payroll documentation when required.
Subcontractor documentation when requested.
Other supporting documentation required by CTCLUSI or the funding agency.

CTCLUSI may return incomplete or unsupported payment requests to the Contractor for
correction.

13. SCHEDULE DELAYS AND EXTENSIONS

The Contractor shail diligently prosecute the Work and maintain sufficient staffing, supervision,
materials, equipment, and subcontractor coordination to meet the approved project schedule.

The Contractor shall promptly notify CTCLUSI in writing of any condition that may materially
delay completion of the Work.

A request for an extension of Contract time shall identify:

Cause of the delay.

Date the delay began.

Activities affected.

Number of additional calendar days requested.
Actions taken to minimize the delay.
Supporting documentation.

Extensions of Contract time shall not be effective unless approved in writing by CTCLUSI.

Delays caused by the Contractor, its subcontractors, suppliers, staffing, scheduling, or failure
to reasonably coordinate the Work shall not automatically entitle the Contractor to additional
Contract time or compensation.

14. LIQUIDATED DAMAGES - (NOT APPLICABLE)

Include this provision only if CTCLUSI determines that liquidated damages are
appropriate for this project.

If the Contractor fails to achieve Substantial Completion within the Contract time, as adjusted
by approved Change Orders or authorized extensions, the Contractor may be assessed
liquidated damages in the amount of $ per calendar day for each calendar day
completion is delayed.

Liquidated damages are intended to compensate CTCLUSI for reasonably anticipated costs
and impacts associated with delayed completion and are not intended as a penalty.

The amount and conditions applicable to liquidated damages shall be established in the final
Contract.

15. TERMINATION

CTCLUSI reserves the right to terminate the Contract for cause when the Contractor materially
fails to perform its obligations, including failure to prosecute the Work, comply with applicable
laws or Contract requirements, maintain required insurance or licenses, correct defective
Work, comply with safety requirements, or otherwise materially breaches the Contract.

CTCLUSI shall provide notice and an opportunity to cure when required by the Contract or
applicable law.

CTCLUSI may also reserve the right to terminate the Contract for convenience upon written
notice to the Contractor. In the event of termination for convenience, compensation shall be
limited to allowable amounts for Work satisfactorily performed through the effective date of
termination and other amounts specifically authorized under the Contract.

Termination rights and procedures will be further defined in the resulting Contract.

16. SOVEREIGN IMMUNITY

Nothing contained in this RFP, the Contractor's proposal, negotiations, communications, or the
resulting Contract shall be construed as a waiver, express or implied, of the sovereign

immunity of the Confederated Tribes of Coos, Lower Umpqua and Siuslaw Indians, its
entities, officers, employees, or agents.

Any waiver of sovereign immunity must be expressly authorized by the Tribe in accordance
with applicable Tribal law and must be specifically stated in writing.

No employee, representative, contractor, or agent of CTCLUSI has authority to waive the
Tribe's sovereign immunity except as expressly authorized under Tribal law.

17. GOVERNING LAW AND JURISDICTION

_ The resulting Contract shall be governed by applicable Tribal and federal law, together with
other law expressly made applicable by the Contract or funding requirements.

Nothing contained in this RFP or resulting Contract shall be interpreted as consent by
CTCLUSI to the jurisdiction of any state or federal court or other forum, or as a waiver of
sovereign immunity.

Any dispute resolution process, governing law provision, jurisdiction, or venue applicable to the
resulting Contract shall be specifically established in the final Contract approved by CTCLUSI.

18. CTCLUSI CONTRACT REQUIREMENT

The successful Proposer will be required to enter into a written Contract approved by
CTCLUSI before beginning Work.

Submission of a proposal does not constitute a Contract, authorization to proceed, or Notice to
Proceed.

The successful Proposer shall not begin Work, order materials for reimbursement, mobilize to
the project site, or incur costs on behalf of CTCLUSI until the Contract has been fully executed
by authorized representatives and CTCLUSI has provided authorization to proceed.

The Contractor's proposal may be incorporated into the Contract; however, in the event of a
conflict among the Contract Documents, the order of precedence established in the final
Contract shall control.

Any Contractor terms and conditions included with a proposal shall not become binding upon
CTCLUSI unless expressly accepted and incorporated into the fully executed Contract.

PROPOSER OFFER, WITHDRAWAL, AND MODIFICATION

Any proposal submitted in response to this RFP will be regarded by CTCLUSI as a binding offer
by the Proposer to complete the work described above for a period of ninety (90) calendar days
from the date proposals are due. This period may be modified upon the mutual agreement
between CTCLUSI and Proposer. Proposals may be withdrawn or modified prior to the date and
time proposals are due by written request. Proposals may not be withdrawn or modified after the
date and time proposals are due unless agreed to by CTCLUSI in writing.

RESERVATION OF RIGHTS

The Coos, Lower Umpqua & Siuslaw Indian Tribe reserves all rights (which may be exercised
by The Tribe in its sole discretion) available to it under applicable laws, including without
limitation, and with or without cause and with or without notice, the right to:

Cancel this RFP in whole or in part, at any time before the execution of a contract by The
Coos, Lower Umpqua & Siuslaw Indian Tribe, without incurring any cost, obligations, or
liabilities.

Issue addenda, supplements, and modifications to this RFP.

Revise and modify, at any time before the RFP submittal due date, the factors and/or
weights of factors The Tribe will consider in evaluating RFP submittals and revising or
otherwise expanding its evaluation methodology as set forth herein.

Extend the RFP submittal due date.

Investigate the qualifications of any firm under consideration and require submittal
confirmation of information furnished by a firm.

Require additional information from a firm concerning the contents of its RFP until such
time as The Tribe declares, in writing, that a particular stage or phase of its review of the
responses has been completed or closed.

Reject at any time, any or all submittals, resoonses, and RFP submittals received.
Terminate, at any time, evaluations of responses received.

Appoint an evaluation committee to review RFP submittals or responses, make
recommendations, and seek the assistance of outside technical experts and consultants
in RFP submittal evaluation.

Hold interviews and conduct discussions and correspondence with one or more of the
firms responding to this RFP to seek an improved understanding and evaluation of the
responses to this RFP.

Seek or obtain data from any source that has the potential to improve the understanding
and evaluation of the responses to this RFP.

Waive deficiencies in an RFP submittal, accept and review a non-conforming RFP
submittal or seek clarifications or supplements to an RFP submittal.

The Tribe is issuing this RFP in accordance with applicable laws to select a qualified and
appropriately licensed General Contractor that demonstrates proven experience and
expertise in building renovation and construction projects of similar size, scope, and
complexity. The selected General Contractor will work closely with Tribal staff and will be
responsible for overall project management, construction coordination, supervision,
scheduling, and coordination of subcontractors and trades necessary to successfully
complete the project in accordance with the Contract Documents, applicable codes,
permit requirements, and the approved project schedule.

The Tribe reserves the right to terminate this process or to cancel or modify this
solicitation process at any time. In no event will The Tribe or any of its respective agents,
representatives, consultants, directors, officers, or employees, be liable for, or otherwise
obligated to reimburse the costs incurred in preparation for this RFP or any other related
costs. The prospective firms shall be fully responsible for all costs incurred in the

preparation and/or presentation of the RFP submittals. The RFP submittals will become
the property of The Tribe.

O. The Tribe reserves the right to reject any or all proposals submitted or make modifications
to the scope of work, subject to appropriate negotiation, during the design process.

P, The final decision is the sole decision of The Tribe, and the respondents to this formal
request have no appeal rights or procedures guaranteed to them.
