QUESTION PRESENTED FOR REVIEW

Did the trial court deny the best interest of the child and
infringe on the father’s constitutional and fundamental
rights to due process and the equal protection of the law,
guaranteed by the 14" Amendment and the Parental
Kidnapping Prevention Act of 1980 (PKPA) 28 U.S.C. §
1738A in his attempt to establish visitation rights with his
child in the state of Florida, when the trial court without
any objection, argurnent or pleading excluded a finding of
severe alienation of affection, which was conclusively
admitted at trial as a matter of law, thereby permitting the
mother to relocate the parties’ minor child to the state of
Texas?

PARTIES TO THE PROCEEDINGS
EFRAIN AREIZAGA, father of the parties’ minor child
born out of wedlock, and an individual on behalf of himself

and a class of all persons similarly situated.

JODY SPICER, mother of the parties’ minor child.
