COUNTER STATEMENT OF THE CASE.

About two days before Saturday, December 15, 1945,
Aaron Turner, alias “Treetop,” reconnoitered or observed
the premises of the Ace Broom Factory, at 355-57 North 2nd
Street, in the City and County of Philadelphia, and then
conspired with Jasper Johnson, alias James Jacksdn. alias
“Fats,” alias “Playboy,” this appellant, and one Clarence
Lofton, to commit a robbery.

These three men went to the Ace Broom Company fac-
tory about five o'clock on Saturday afternoon, December
15, 1945, and Aaron Turner, alias “Treetop.” was armed
with a sashweight or pipe. Clarence Lofton stood outside
and acted as the look-out. Aaron Turner entered the prem-
ises with or just ahead of Jasper Johnson, appellant. As
they entered they met Frank Enders, and Aaron Turner
struck him in the head with the sashweight or pipe, knock-
ing him to the floor, causing injuries from which he died at
the Hahnemann Hospital two days later, December 17, 1945.
While he was lying on the floor of the front office of the
Ace Broom Factory. Jasper Johnson. this appellant, went
through his pockets and extracted therefrom about $175,
The noise which had been occasioned by the killing of
Enders caused Charles Simmons. the proprietor of the Ace
Broom Factory, to run into the front room from the rear,
and as he did so, Aaron Turner, alias “Treetop.” hit him
with the sashweight or pipe, knocking him to the floor, and
causing injuries from which he died in the Hahnemann
Hospital seven days later, December 22, 1945. While
Charles Simmons was lying upon the floor, Aaron Turner,
alias “Treetop,” robbed him of an unknown sum estimated
to be from one hundred to several hundreds of dollars. They
thereupon ran out, joined the look-out. Clarence Lofton, and

or persons unknown.

MR. BURKE: I think, your Honor, that these members
of the Detective Division are to be commended for a very
fine piece of detective work in cleaning up this mysterious
