forward which have been recently made in obtaining
and protecting the rights of criminal defendants to a
trial by juries selected in such a manner as to reason-
ably assure a representative cross section of the com-
munity. To prevent this Certiorari should be granted.

3. The question of whether or not a combination of
all of the facts involved in a criminal proceeding can
be viewed in their entirety to determine whether or
not a criminal defendant has had a fair trial is worthy
of consideration by this Court. The question of whether
or not the onduct of the Jury Commissioners in select-_
ing jurors for the Central Division of the District Court
' for the District of South Dakota, the failure of the gov-
ernment to comply with the provisions of the discovery
order and of Rule 16, coupled with other error con-
tained in the record should be considered in its entirety
to determine whether such events had a substantial
_ effect on the result of petitioner’s trial goes to the very
heart of a determination of what constitutes harmless
error and what constitutes prejudicial- error. See
Kotteakos v. Umited States, 328 U.S. 750.

_ Where a series of events such as are shown in the

record in this matter exist a criminal defendant should
have the right to have the record looked at in its en-
tirety to determine whether or not he received a fair
trial.

submits that the Petition for a Writ of Certiorari
