OF THE FEDERAL AVIATION ACT TO SUSPEND A
PILOT'S AIRMAN CERTIFICATE AS A SANCTION
SOLELY FOR ITS DETERRENT EFFECT ON OTHER

PILOTS.

II. WHETHER THE ORDER OF SUSPENSION
IMPOSED SOLELY FOR DETERRENT EFFECT IS
ARBITRARY, CAPRICIOUS AND AN ABUSE OF
DISCRETION IN CIRCUMSTANCES IN WHICH THE
AIRMAN IS FOUND TO BE FULLY REHABILITATED
