Reason For Application To Extend Time To
Submit Writ of Certiorari Being Late By
32 minutes

Eastern Airlines gave erroneous shuttle
flight information to petitioner upon which
petitioner relied to permit the submission
of his Application to Extend by three weeks
the time to submit subject writ to this
Court,

The information originally given to
petitioner by Eastern provided for a safe
time margin for unforseen contingencies,

Petitioner advised and personally met
with Eastern'’s Supervisor of Air Shuttle
Services, Mr. Frank J. Horn at LaGuardia
Airport in New York City. Mr. Horn ack-
nowledged Eastern's error which confused
the LaGuardia to Boston Shuttle with the
LaGuardia to Washington National Airport
shuttle, Mr. Horn was advised by peti-
tioner of the serious implications of
Eastern‘’s error and Mr. Horn arranged for
a special light aircraft to fly petitioner
to the Washington, D.C. National Airport
in the hopes of making the midnight dead-
line, Eastern also arranged for a car to
be waiting for petitioner at National Air-
port, at their expense, in order to expe-
dite the submission of subject papers.

The charter service contacted by Eastern
through Butler Aircraft was Sound Air
Aviation, They flew a plane into LaGuardia
from MacArthur Airport in Ronkonkoma, Long
Island, New York, to pick up petitioner
and fly him to National Airport.
