Pleadings

In US exceptions. Ferrin contends that the examiners erred in considering al!
applications on an erroneous concept that ali must be granted wr all denied and in
finding that a grant of the Herrin application would result in a realignment of the
traffic patterns and competitive relationships of existing carners. Herrin submits that
ut does not seek to extend its operations beyond us present terruory but seeks only to
serve seven specific points which are actually intermediate under Herrin’s presently
authorized operations. Inasmuch as Herrin can now provide service to and from
Atlanta. assertedly a grant of authority to and from this point would merely allow it to
use ell feasible routes for the operations. lt believes that the examiners erred in
concluding that the transi studies and , ciated testimony. as a whole. do not warrant
the conclusion that the existing service is inadequate to mee: the real needs of the
shipping public in the territory involved in the Herrin application. Herrin excepts to
the findings and conclusions of the examiners that it failed to prove that the public
convenience and necessity require the grant of us application. and it submits that in
considering the criteria for selection of applicants i is a logical choice

Red Ball contends that the examiners erred in concluding that the 933 public
wunesses failed to establish a need for additional carrier service and that a grant of us

spplication would have an adverse affect on existing carrier service. Assertediy, the
10 public witnesses presented by Red Ball. the adduional 24 witnesses called by

her parties but testifying in support of Red Ball. and the additional 19 witnesses who
testitied in support of all applications clearly demonstrate a need for this applicant's
proposed service. It 1s contended that the inequity of the examiners’ handling of this
proceeding is demonstraied Dy their failure to even discuss that portion of Red Ball's
Proposal which was unopposed Applicant submits that protestant East Texas has filed
an appluatiwen ia MC 41432 (Sub-No. 103) seeking authority substantially indentical to

herein Red Bali further contends that the examiners erred in concluding that all of
the applications must be treated together and im not giving compiete and fair
ireatment to the individual applications [i submits that newher the carriers opposing
us application nor the applicants in this proceeding can provide the extensive single
lune service proposed by Red Ball between those points presently served by it in
Mississippi. Louisiana. Arkansas, Texas. New Mexico. Colorado. and Kansas City.
Kans.-Kansas City, Mo.. on the one hand, and. on the other, Atlanta, Birmingham. and
Greenville And, assertedly. u is the one applicant in this proceeding that can and will
solve the problem of bringing to the smalier cities, towns, and communities adequate
and proper transportation service to and from major points of supply and distribution
such as Atianta and Birmingham. Red Ball is willing to have “Performance Report”
conditions similar to those imposed in West Brothers, Inc., Extension—Baton Rouge,
La, 106 M.C.C 792 (1968), as modified in 108 MCC. 485 (1969). imposed on a grant
of authority to a. Finally. it asserts that of all the applicants it is best suited. equipped.
and establish, and can, at less cost, perform the service between the points it proposes
to serve

In us conditional exceptions. Deaton submits that if this record discloses a public
need for additiwnal service between Atlanta and Birmingham. on the one hand, and.
un the other, Dallas and Houston.ut believes that a grant of its application would be a
necessary corullary to the granting of one or more of the other applications. The filing
of us application is described as an effort to keep pace with fundamental realignment
of existing motor carrier operational patterns in the Southwest which would result
from the granting of any or all of the eight applications « opposes

On excepisons. Strickland contends that the examiners erred (1) in recommending a
demal of the Strickiand application, (2) in failing to evaluate the merits of Strickland’s
application separate and apart from consideration of the proof offered by other
applicants. (3) in equating growth im existing carriers with capability to adequately
meet the growimg transportation requirements of supporting witnesses, (4) in finding
that where complaints of service failures had been made to existing carriers remedial
action has been taken. (5) in finding that the evidence does not warrant the conclusion
that the quality of service proposed by applicants would be sufficiently superior to that
of Cassting Carrier services to support a grant of the operations proposed. (6) in placing
undue emphasis throughout their report on the fact that various applicants to the
consolidated proceedings were also prorestants to other cases instead of considering
established criteria for proving public convenience and necessity in each instance.
especially with respect to the application made by Strickland. and (7) in finding that
the granting of the Strickland application would result in a material adverse affect on
caisiing Carrier services, and could put Red Line out of business

Baggett. in its conditional exceptions, indicates that initially in was a “defensive
applicant and was willing to withdraw its application if all other applicants agreed to

deo the same. When it became clear that the other applicants would not withdraw their
applications, Baggett indicates that « became a “serious applicant ~ Baggett contends
that the 40 pubiic witnesses who supported its application proved a definite need for
direct. singie-line service as related to their respective businesses. It believes that a
grant of its application would be a necessary corollary to a grant of any of the other
applications and it mdicates that exceptions were filed to avoid a situation in which its
application would stand finally denied while one or more of the other consolidated
applications are pending final decision

Bowman contends on exceptions that the examiners erred (1) in considering ali 10
applications collectively, and neglecting and failing to relate the testimony to the
Bowman proposal or to give effect to the multiple complaints directed toward existing
carriers. (2) in considering and treating the testimony only in relation to commodities
shipped to the substantial exclusion of territories and points involved: (3) in tarling to
consider the divisible aspects of the Bowman application, (4) in failing to recommend
approval of the Bowman proposal to serve 10 named Mississippi points. Topeka and
Kansas City. Kans.. and Kansas City. Springfield. and Carthage, Mo.. (5) in failing to
recommend approval of all aspects of the Bowman application. and (6) in arriving at
ultumate conclusions and basing thew recommendation on broad generalities without
specific findings as to the basic facts of record. With respect to the divisibdility of ms
proposal, Bowman contends that only three general-commodity carriers and one
specialized carrier have any interest in the propwsal to serve the Kansas-Mussour area.
and only seven carriers are interested in the Mississippi portion of its proposal. It
asserts that the strongest case presented by any applicant was of a need for additional
motor carrier service between the authorized Bowman territory. on the one hand, and.
on the other, (1) the 10 named Mississipp: points. and (2) Topeka and Kansas C ity.
Kans.. and Kansas City. Springficid and Carthage, Mo. It is pointed out that more
public witness (137) testified in support of the Mississippi portion of the Bowman
proposal than appeared for all aspects of 7 of the 10 applicants and more than al!
witnesses combined of 3 of the applicants. Bowmen believes that if the application had
been filed simply for authority between its terr tory in the South and the afore-
mentioned Missouri and Kansas points. it wou'd have received a grant of authority
Assertedly, the 82 witnesses which supported this portion of the application have
experienced every conceivable type of difficulty with the existing motor carrier serv-
ice. Bowmar. submus that only four carriers hold general-commodity authority be-
tween the wivolved Kansas-Missouri area and any portion of the Southeast. and only
three of these carriers. viz. Gordons. Watson-Wilson, and T1.ME.. oppose this
portion of Bowman's application. Furthermore. it is contended that these three
carriers. what they hold extensive authority im this area. collectively serve only a
lumited number of points in Alabama, Tennessee. Georgia. and South Carolina
Bowman submits tne: ven if these carriers served every one of their authorized points.
there would still be no service, (1) from the entire State of Florida; (2) from points in
Georgia south of US. Highway 80. (3) from points in South Carolina north of
Greenville. Columbia. and Charleston: and (4) from the entire States of North
Carolina and Virginia

On exceptions. Johnson contends that the examiners erred (1) im generally merging

points in New Engiand and western Pennsylvania which Johnson does serve. Bowman.
unlike Johnson. does. however. serve the gatewass of Memphis. Tenn. and
Birmingham It is submuted that Bowman's proposal extends much further territorially
than that of Johnson Johnson indicates that only Roadway and Ryder offer singic-line
service between points on the eastern seaboard. on the one hand. and. on the other
points Johnson proposes to serve. However. u is contended that these carriers are
highly selective in the traffic they will handle and they are nut able to serve all of the
points Johnson preseatly serves. Further. Johnson contends chat in view of the fact
that after the commencement of these proceedings Kv.adway «as authorized in another
preceeding to acquire substantially the same rights which wt os seeking herein.
regardiess of any possible diversion from the carriers protesting the Roadway
application herein, « would be a miscarriage of justice for the Commission to deny
Johnson's application because of its possibile effect on Roadway Although several cast
coast carriers (Pilot, Mason and Dixon. ETAWNC, Mercury Motors. and Carolina)

Additionally. it is pointed out that such major east/south carriers as Associated
Transport Inc.. Branch Motor Express. Inc.. Hennis Freight Lines. McLean Trucking
Company, and RC. Motor Lines failed to participate herein Johnson contends that
masmuch as an important segment of the joint- line system did not protest the Johnson
application and newher evidenced the service they have available nor its adequacy or
the smpact upon them of a grant of authority. there is no substantial evidence in the
record to support the examiners findings that there is available exsting joint line
service adequate to meet the needs of the shippers

On exceptions. Jones contends that the examiners erred im fasling to find that the

failing to award the grant of such authority to this applicant. With respect to
refrigerated service. Jones points out that it operates 11! trailers equipped with
mechanical refrigeration. which is more than all of the other applicants collectively
operate. It handles combination loads of perishable and nonperishable commodities in
the same trailer and u presently provides LTL refrigerated service to a number of
shippers. Assertedly. if the volume of refrigerated traffic shippers have shown to be
moving is considered on an annual basis shipments to Atlanta would exceed 37
million pounds a year and approximately 4 million pounds would move annually to
Birmingham. Annually. 10.5 million pounds moves outbound from Atlanta to points
Jones is authorized to serve. At least one of the supporting shippers indicates that it
cannot ship commodities requiring refrigeration from Atlanta to points in Arkansas
and Mississippi during the summer months because refrigerated service is not available
Jones submits that it is the only applicant herein which presently provides LTL
refrigerated service. With respect to existing service. Jones submits that the examiners
erred in finding that the complaints were minimal and that shippers have recourse
where carriers refuse to render service. Jones indicates that it is not interested in
traffic moving between Atlanta and Birmingham and it 1s willing to have a grant of its
application restricted accordingly. Also it expresses a willingness to accept a
restriction against the transportation of traffic between Atlanta and Dallas which does
mot require temperature controlled trailers. Finally. Jones contends thai if the
mvolved application were not heard on a consolidated record. it would have received
a grant of authority

The 41 intervening shippers which support the Johnson application. in their jointly
filed execptions. contend that the examiners erred in recommending a more
cooperative effort between carriers and suppers as a substitute for competition
Assertedly. the examiners should have found that both the public convenience and
necessity and the national transportation policy encourages COMPEetition among
carriers as a means for improving inadequate service. Further. imterveners maintain
that the examiner erred (1) im concluding that the Commission must grant existing
Carriers an opportunity to remedy deficiencies in service before authorizing proposed
service by another carrier. (2) in determining public convenience and necessity by
placing considerations of possible detriment to existing carriers Yhrough increased
competition ahead of benefit to the public; (3) in concluding that “the primary issue ts
not so much the availability of service. but whether the quality of the existing
authorized services ws adequate to meet the needs and requirements of the public’.
and (4) by sidestepping the consideration of “mopopolistic tendencies in evaluating
the existing motor carrier services in order to encourage Competition, innovation, and
improvement of service to the public ***” Interveners submit that suppression of
Competition runs counter to both the letter and spirt of the Federal antitrust laws. that
only where the intent of Congress is clear and manifest has subsequently enacted
regulatory legislation exempted specific practices from the operation of the anturust
laws, and that absent such a showing the antitrust laws are applicable to a situation
where, as here, through the denial of additional service. a monopoly is assured to
those carriers already in the ficid in a particular area Assertedly, the Commission
should reverse the examiners’s decision and grant the application of Johnson. Because
of the complexity of this proceeding and its importance in terms of public interest, the
intervening shippers request that oral argument before the Commission be granted

service standards. Protestants point out that although intervening shippers ecacepiiwons
make statements of fact. there are no citations to the record and imasmuch as the

Rules of Practice it should be stricken or rejected. or given lutie of mo consideration

shippers in support of the application of Johnson for oral argument should be dened
inasmuch as the issues are not complicated and relate principally to a question of fact

Johnson. in reply to the contentions of Campbell and Gordons that thus application
should be denied because it involves the bridging of regular routes with an irregular
route. as well as the joinder of regular and irregular routes. submits that its proposed
regular routes join its present system at New Orleans, La.. and Atlanta. which pois
are located on its present regular-route systers. that any bridging operation over
highways in irregular-rowte territory. if it takes place at all. will be confined to
truckload traffic. that it does not propose to directly join proposed regular routes with
existing irregular-route authority, and that although it does tack regular wuh wregular
route authority at common service points. it preserves the character of the respective
authorized services. With respect tw the conditional exceptions of Deaton and Bagge!
Johnson submits that the former did not show the impact upon it of a grant of only the
Johnson applicaiion and the latter did not prove thai a grant of the Johnson
application also warrants a grant of the Baggett application Replying to the
exceptions of Herrin, Red Bali, and Strickland, Johnson asserts that its proposal to
serve “key points” should not be regarded as “slighting” the smal! community
Instead, Johnson submits that it is a practical solution to the maintenance of
reasonably adequate service in the transportation of small shipments at large cities as
well as to the medium and small communities in the Southwest Singie-line service
will be provided to the large communities proposed to be served and Johnson wii!
provide the long-haul! portion of joint-lime service for the shippers and receivers
located at the medium and smal! communities in the Southwest [1 indicates that it has
obtained from proposed connecting carriers an indication of their willingness to
cooperate im the plan.

In their yornt reply to the exceptions filed on behalf of Johnson. certain protestants
contend that Johnson's proposal. as tested by Johnson's performance. is not realistic
They contend that Johnson's testimony. that its entire operation was to be converted
from a relay operation to a sleeper-type of operation is of no value since Johnson
failed to introduce imio evidence any indication of the progress under the proposed
change in its operation, if in fact, such change actually took. or will take. place
