## Opinion text

I concurred specially in Wright v. Holy Name of Jesus Medical Center , 628 So.2d 510 , 514 (Ala. 1993), because I felt bound by the doctrine of stare decisis. I can materially distinguish this case from Wright and the cases cited in my special concurrence in Wright ; therefore, I respectfully dissent.
