## Opinion text

THE COURT.
The petition for rehearing is denied. In denying the same, however, we withhold our approval from that portion of the decision of the district court of appeal wherein it was held that the trial court was in error in admitting certain evidence offered by the prosecution to impeach the witness Garcia. In our opinion such evidence was properly admitted and the appellate court was in error in holding to the contrary. In all other respects, however, we are in accord with the decision of the district court of appeal.
