## Opinion text

On Motion for Further Rehearing.
On a former day of this term, by order of this court, the costs incurred below in this cause incident to bringing H. C. Ferguson into this case were taxed against Agnew & Agnew. Through a motion filed in this cause by Agnew & Agnew, our attention has been called to the fact that H. 0. Ferguson was brought into the case in the trial court by the Lubbock Hardware & Furniture Company, and for this reason the motion of Agnew & Agnew to retax the costs as to this item is granted, and the order heretofore entered, taxing said item of costs against Agnew & Agnew, is set aside, and said costs are here taxed against said Lubbock Hardware & Furniture Company.
