KAUS, P. J.
I concur in all respects, except that as far as the last point in the court’s opinion is concerned, I would rest the affirmance solely on People v. Manis, 268 Cal.App.2d 653, 667 [ 74 Cal.Rptr. 423 ].
Appellant’s petition for a hearing by the Supreme Court was denied August 9, 1972.
