dissenting.
J^agree that, (1) in the absence of a written agreemént containing express language to the contrary, and (£>-as'long as it does not'Viol^te due process, a college marfrespond to a bona fide financiaremos by terminating' the employment of tenured professors. Give^he^faetual background and procedural history of this case,, hówevéiy-Uam persuaded that the trial judge was not required to accept appellant’s tardy explanation for theAerminations at issue. I would therefore affirm the judgment of the circuit court, of need, enrollment, duplicationfetc., was a candidate for termination.
