HAWTHORNE, Justice
(dissenting in part).
I cannot agree with the majority’s conclusion in regard to Bill of Exception No. 9. For the reasons stated in my opinion on original hearing I think this bill shows that reversible error was committed and the accused is entitled to a new trial.
