## Opinion text

CARAWAY, J.,
concurring.
I would affirm the trial court’s ruling on the basis of the civil courts’ lack of subject matter jurisdiction over the relationship between a church and its members. I disagree with the statement that the statutory provisions for nonprofit *1145 membership, La. R.S. 12:210, govern membership in a church. The fact that St. Elizabeth Baptist Church has utilized the nonprofit corporation law of this state does not take this church membership conflict out of the ecclesiastical realm under allegations which plaintiffs now present. State ex rel. Johnson v. Tulane Ave. Baptist Church, 144 So. 639 (La.App.Orl.1932).
