WHIPPLE, J.,
concurring.
1 pursuant to LSA-R.S. 49:964(A)(2), the agency is precluded from seeking judicial review of an ALJ’s final decision. Thus, I concur in the result reached by the majority, as the res judicata discussion therein ultimately defeats the Department’s arguments.
