MR. JUSTICE ANGSTMAN:
(concurring in dissent).
I concur in the conclusion of Mr. Chief Justice Adair that the case should be decided on its merits.
I express no opinion as to whether the trial court’s opinion was or is right or wrong on the merits of the ease since that question is not considered in the majority opinion.
