McCOMB, J.
I dissent.
I would reverse the judgment for the reasons stated by Mr. Justice Coughlin in the opinion prepared by him for the District Court of Appeal in Rohr Aircraft Corp. v. County of San Diego, (Cal.App.) 330 P.2d 291 .
Appellant’s petition for a rehearing was denied April 15, 1959. McComb, J., was of the opinion that the petition should be granted.
