I dissent. I would affirm the judgment for the reasons expressed by Mr. Presiding Justice Stone in the opinion prepared by him for the Court of Appeal, Fifth Appellate District (Bekiaris v. Board of Education of the City of Modesto, Civ. No. 1268, filed January 14, 1971, certified for nonpublication).
