Hoekstra, P.J.
(dissenting). I join the result reached in Judge Whitbeck’s dissenting opinion and its resolution of the issues addressed in parts i, n, and m. However, I express no opinion concerning the issue of retroactivity addressed in part iv because the record in this case is not fully developed in this regard and the issue was not fully briefed by the parties.
