Mallery, J.
(dissenting)—I think the right of way rule as qualified by Martin v. Hadenfeldt, 157 Wash. 563 , 289 Pac. 533 , to which this court has steadfastly adhered for many years, is abrogated by the majority ruling on instruction No. 11.
I, therefore, dissent.
