WELCH, J.
(dissenting). I think the court committed reversible error in violating the well established rule requiring that the defendant’s theory of defense be presented to the jury by appropriate instruction duly requested by defendant when there was evidence tending to establish such defense.
I am authorized to say that GIBSON and O’NEAL, JJ., concur in this dissent.
