McALLISTER, J.,
dissenting.
In my opinion this case was properly decided by the Court of Appeals. I agree with that court that the legislative history of OES 656.298 (1) indicates an intent to adopt a jurisdictional requirement. If such a statute produces undesirable results any change should be made by the legislature and not by this court.
