Weaver, J.
(dissenting) — I concur in the result of Judge Foster’s dissent that grants a new trial, with directions to exclude the confession if offered.
My reasons are expressed in that portion of the dissenting opinion that discusses the violation, by the police, of RCW 9.33.020(5).
