McCOMB, J.
I dissent. I would reverse the judgment for the reasons expressed by Mr. Justice David in the opinion prepared by him for the Court of Appeal in Wise v. Southern Pac. Co. (Cal.App.) 77 Cal.Rptr. 156 .
