## Opinion text

ABRAHAMSON, P. J., specially concurring.
I concur in the result but not in the reasoning of the opinion. Although the briefs and arguments of both parties are addressed to the issues as determined by a majority of the Court, the undisputed facts disclose that the Board did comply with the requirements of the Building Code of the City and as a result the only question presented in this appeal is whether or not the Board is exempt from the payment of a permit fee.
