concurring:
I concur in the opinion of the Court except for part II.D. The Court is not called upon to address the VCAA here because “neither party ... has argued that application of the VCAA could be beneficial to the appellant.” Williams (Shirley) v. Principi, 15 Vet.App. 189, 199 (2001) (en banc) (Kramer, C.J., with whom Steinberg, J., joined, stating separately).
