DOLAN, J.
I concur that this case does not present a casualty within the meaning of Section 3 (b) (2) of the By-Laws. I would remand the case for a consideration of whether the precedent established in the case of In the Matter of 244-245 Cypress Street, Docket No. 655 of the Rént Control Board of the Town of Brookline, relieves the Appellees from the removal permit requirement of the By-Laws.
