## Opinion text

Shepherd, J.,
concurs with the Court’s opinion with the exception of the determination that the trial court erred in awarding $150 per hour for trial time. While he is in no position to say that he would have granted such an amount, he does not believe that the trial judge abused his discretion in doing so and he would therefore affirm the award of $150 per hour for trial time.
