Smith, J.
(dissenting); I dissent from paragraph 5 of the syllabus and the corresponding part of the opinion. Briefly my-views are that the highway commission does not need anything but an easement and the legislature never intended for it to take any more than it needed. I could elaborate more fully upon this but lack the time.
