| FITZSIMMONS, Judge,
concurring with reasons.
I respectfully concur in the result. I do not feel comfortable with the inclusion of footnote 2 in the report, which addresses entitlement to immunity per La. R.S. 9:2798.1. Were the facts different, such that the District had caused damage to owners’ property by causing the water to flood over the bank, it is questionable *1133 whether the immunity provision would apply-
