CRAWLEY, Judge,
concurring specially.
I agree with the majority that Akzo may not terminate Gilliam pursuant to Ala.Code 1975, § 25-5-8(g)(2). However, Akzo would not be precluded from terminating Gilliam on other independent grounds.
