hLeBLANC, Judge,
dissenting.
I respectfully dissent from the portion of the majority opinion which affirms the denial of summary judgment as to Mr. Lynch. Under the particular facts and circumstances of this matter, it is my opinion that, based on the functions served by Mr. Lynch, he too, is entitled to immunity. See Butz v. Economou, 438 U.S. 478 , 98 S.Ct. 2894 , 57 L.Ed.2d 895 (1978).
