DUFRESNE, J.,
concurring with written reasons.
I concur with the majority in reversing the trial court, however, the peremption of R.S. 9:2772 should have been applied to both Link Belt/FMC Corporation and Rust Engineering Company. The conveyor was an improvement to immovable property performed in 1948, thus the claim against Link Belt/FMC Corporation and Rust has been perempted thru the operation of La. R.S. 9:2772.
