ON REHEARING
BOWEN W. SIMMONS, Retired Circuit Judge.
Upon further consideration of this cause, the judgment of the Circuit Court is reversed and judgment is here rendered discharging the appellant from further prosecution in this proceeding.
OPINION EXTENDED, APPLICATION OVERRULED.
