MONTGOMERY, J.,
concurring. I concur in the result, but I do not wish to be bound by that part of the opinion in which is discussed the motives of the members of the General Assembly in the enactment of chap1. 164 of the Laws of 1899; nor do I think it is my part, in a judicial opinion, to- make any explanations for them.
