McMurray, Presiding Judge,
concurring specially.
I concur fully in the judgment of affirmance and in all that is said in the majority opinion. In addition, I refer to and adopt all that is said in my special concurrence in Plemons v. State, 155 Ga. App. 447, 454 , supra, joined in by Judge (now Justice) Smith, Judge Banke, and *590 in part by Judge Sognier, who also specially concurred.
