Mason, J., also delivered an opinion for affirmance; Selden, Lott, James and Hoyt, Js.,
concurred, without however passing upon the question first discussed, as to the construction of our statutes, as to which four of the judges were understood to express a different opinion from that stated by Judge Denio.
