Davis, P. J., dissenting.
I think the order in this case should be reversed and the matter sent back to the special term for a rehearing, on which rehearing the facts can be more fully and fairly presented. There is danger of doing great injustice to the city without a fuller presentation is made of the facts which ought to determine the questions involved herein.
