Thornton, J., dissenting.
I dissent from the judgment in this case, and from the order denying a rehearing. I think there was no error in the instructions given in the case. They accord with the ruling in People v. Hong Ah Duck, 61 Cal. 387 , and People v. Raten, 63 Cal. 421 .
