MILLIKEN, PALMORE and STEINFELD, JJ.,
dissent on the ground that in their opinion the question of whether the movement and proximity of the passing vehicle suddenly created an apparent emergency was properly submitted to the jury. Cf. Brown v. Todd, Ky., 425 S.W.2d 737 (1968).
