DAYIDSON, P. J.
(dissenting). The testimony mentioned in the bills of exception ought to be excluded under the Drake Case, 29 Tex. App. 265, 15 S. W. 725 , and that line of cases, including the late case of Hickey v. State, 138 S. W. 1051 .
