concurs in part and . dissents in part, and assigns reasons.
hi respectfully concur with the results reached by the majority. However, I respectfully disagree with the majority overruling Tyler. The facts of the Tyler case and the facts of this case are easily distinguishable, and it was not necessary for this court to overrule Tyler.
