PITTMAN, Judge,
concurring in the result.
I continue to adhere to my dissent in City of Dothan Personnel Board v. DeVane, 860 So.2d 881, 892 (Ala.Civ.App.2002) (Pittman, J., dissenting); however, because the main opinion in DeVane is binding precedent, I concur in the result in the present case.
