McCLENDON, J.,
dissents and assigns reasons.
hit is clear that Mr. Boyne was the aggressor and could have walked away from the confrontation at any time prior to throwing the punch. Therefore, I find that the intentional act exclusion in the policy applies. Accordingly, I must respectfully dissent.
